4	10		AN ACT
5	11		relating to the name and powers of the Harris County Improvement
6	12		District No. 17; providing authority to issue bonds; providing
7	13		authority to impose a tax.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. The heading to Chapter 3891, Special District
10	16		Local Laws Code, is amended to read as follows:
11	17		CHAPTER 3891. HARRIS-MONTGOMERY COUNTIES MANAGEMENT DISTRICT
12	18		[HARRIS COUNTY IMPROVEMENT DISTRICT NO. 17]
13	19		SECTION 2. Section 3891.001, Special District Local Laws
14	20		Code, is amended by amending Subdivision (3) and adding Subdivision
15	21		(4) to read as follows:
16	22		(3) "District" means the Harris-Montgomery Counties
17	23		Management District [Harris County Improvement District No. 17].
18	24		(4) "Recreational facilities" has the meaning
19	25		assigned by Section 49.462, Water Code.
20	26		SECTION 3. Section 3891.002, Special District Local Laws
21	27		Code, is amended to read as follows:

23		-	ATURE OF DISTRICT. The Harris-Montgomery

24	29		Counties Management District [Harris County Improvement District
25	30		No. 17] is a special district created under Section 59, Article XVI,
26	31		Texas Constitution.
27	32		SECTION 4. Subchapter A, Chapter 3891, Special District
28	33		Local Laws Code, is amended by adding Section 3891.008 to read as
29	34		follows:
30	35		Sec. 3891.008. INAPPLICABILITY OF OPTION TO SELECT
31	36		EXTRATERRITORIAL JURISDICTION. Section 54.0163, Water Code, does
32	37		not apply to the district.
33	38		SECTION 5. Subchapter C, Chapter 3891, Special District
34	39		Local Laws Code, is amended by adding Section 3891.1071 to read as
35	40		follows:
36	41		Sec. 3891.1071. PUBLIC IMPROVEMENT DISTRICT POWERS. The
37	42		district has the powers provided by Chapter 372, Local Government
38	43		Code, to a municipality or county.
39	44		SECTION 6. Subchapter D, Chapter 3891, Special District
40	45		Local Laws Code, is amended by adding Section 3891.1571 to read as
41	46		follows:
42	47		Sec. 3891.1571. BONDS FOR RECREATIONAL FACILITIES. The
43	48		limitation on the outstanding principal amount of bonds, notes, and
44	49		other obligations provided by Section 49.4645, Water Code, does not
45	50		apply to the district.
46	51		SECTION 7. (a) The legal notice of the intention to
47	52		introduce this Act, setting forth the general substance of this
48	53		Act, has been published as provided by law, and the notice and a
49	54		copy of this Act have been furnished to all persons, agencies,
50	55		officials, or entities to which they are required to be furnished
51	56		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
52	57		Government Code.
53	58		(b) The governor, one of the required recipients, has
54	59		submitted the notice and Act to the Texas Commission on
55	60		Environmental Quality.
56	61		(c) The Texas Commission on Environmental Quality has filed
57	62		its recommendations relating to this Act with the governor,
58	63		lieutenant governor, and speaker of the house of representatives
59	64		within the required time.
60	65		(d) All requirements of the constitution and laws of this
61	66		state and the rules and procedures of the legislature with respect
62	67		to the notice, introduction, and passage of this Act have been
63	68		fulfilled and accomplished.
64	69		SECTION 8. This Act takes effect immediately if it receives
65	70		a vote of two-thirds of all the members elected to each house, as
66	71		provided by Section 39, Article III, Texas Constitution. If this
67	72		Act does not receive the vote necessary for immediate effect, this
68	73		Act takes effect September 1, 2019.
