5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to boundaries of the Anthem Municipal Utility District.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Subchapter A, Chapter 7979, Special District
10	10	Local Laws Code, is amended by adding Section 7979.004 to read as
11	11	follows:
12	12	Sec. 7979.004. DISTRICT TERRITORY. (a) The district is
13	13	composed of the territory described by Section 2 of the Act enacting
14	14	this section.
15	15	(b) The boundaries and field notes contained in Section 2 of
16	16	the Act enacting this section form a closure. A mistake made in the
17	17	field notes or in copying the field notes in the legislative process
18	18	does not affect the district's:
19	19	(1) organization, existence, or validity;
20	20	(2) right to issue any type of bond for the purposes
21	21	for which the district is created or to pay the principal of and
22	22	interest on a bond;
23	23	(3) right to impose a tax; or
24	24	(4) legality or operation.
25	25	SECTION 2. The Anthem Municipal Utility District includes
26	26	all the territory contained in the following area:
27	27	BEGINNING at a 1/2-inch iron rod located on the northwesterly right
28	28	of way line of RM 150, an 80 foot wide public right of way, for the
29	29	southwest corner of said 73.693 acre Tract 2, same being the
30	30	northwest corner of a called 17.95 acre tract described in a deed to
31	31	Robert and Linda Rosebrock recorded in Volume 1126, Page 236 of the
32	32	Hays County Deed Records;
33	33	THENCE, with the northwest right of way line of said RM 150 the
34	34	following courses and distances:
35	35	1. N45°54'47"W, 312.73 feet with the westerly line of said
36	36	73.693 acre tract to a Texas Department of Transportation Type 1
37	37	Concrete Monument;
38	38	2. N44°00'03"W, 1476.41 feet tract to a Texas Department of
39	39	Transportation Type 1 Concrete Monument found at the beginning of a
40	40	curve to the left;
41	41	3. with the arc of said curve to the left, passing the most
42	42	southerly southwest corner of said 599.25 acre tract, a found
43	43	3/8-inch iron rod at an arc distance of 39.42 feet, passing the
44	44	southerly corner of a 875 square foot and 0.308 acre tract described
45	45	in a deed to Mountain City - 150, L.P. in Volume 5272, Page 490 and
46	46	continuing for an arc distance of 568.29 feet, having a radius of
47	47	1185.90 feet, a central angle of 27°27'23" and a chord bearing and
48	48	distance of N57°43'45"W, 562.87 feet to a 1/2-inch iron rod with cap
49	49	stamped "AST" set for corner on said northwesterly right of way
50	50	line, same being on the southerly line of a called 581.00 acre tract
51	51	described in a deed to M I W L S, LP and being a reentrant corner and
52	52	most westerly south corner of the herein described tract;
53	53	THENCE, leaving the northwesterly right of way line of RM 150 and
54	54	with the common line of said 581.00 acre tract and said 599.25 acre
55	55	tract the following courses and distances:
56	56	1. N88°36'39"E, 1422.09 feet to a 1/2-inch iron pipe found
57	57	for an angle point in said line;
58	58	2. N88°38'02"E, 25.14 feet to a Mag Nail in concrete for an
59	59	interior ell corner of the herein described tract;
60	60	3. N01°42'12"W, 2818.15 feet to a found 8-inch diameter
61	61	Cedar Fence Post for an interior ell corner of the herein described
62	62	tract;
63	63	4. S87°57'12"W, 2442.13 feet to a found 8-inch diameter
64	64	Cedar Fence Post for an exterior ell corner of the herein described
65	65	tract, same being the southeast corner of said 752.05 acre tract;
66	66	THENCE, with the westerly line of said 599.25 acre tract, same being
67	67	the easterly line of said 752.05 acre tract the following courses

113	113	THENCE, leaving the southwesterly line of said 1974.77 acre tract,

161	161	THENCE, with said easterly line of said 73.693 acre tract and with
162	162	the westerly line of said Lot 6 and 7 of said Century Acres and the
163	163	easterly line of said Lot 2B and 2C Resubdivision of Lot 2B of the
164	164	Resubdivision of Lot 2 Century Acres of record in Document
165	165	No. 17040812 of the Hays County Official Public Records,
166	166	S13°28'59"E, 1658.91 feet to a 1/2-inch iron pipe found for the
167	167	southeast corner of said 73.693 acre tract, same being the
168	168	southwest corner of said Lot 2B and the common northerly corner of
169	169	Lots 8 and 9 of Meadow Woods Section Two, a subdivision of record in
170	170	Volume 3, Page 188 of said Plat Records, same being the northeast
171	171	corner of said 17.95 acre tract;
172	172	THENCE, with the northerly line of said 17.95 acre tract, same being
173	173	the southerly line of said 599.25 acre tract, S88°38'38"W, passing
174	174	an iron rod with cap stamped "McMillan" at 103.02 feet and
175	175	continuing for a total distance of 1505.09 feet to the POINT OF
176	176	BEGINNING and containing, 422.996 acres of land, more or less.
177	177	SECTION 3. The Anthem Municipal Utility District retains
178	178	all the rights, powers, privileges, authority, duties, and
179	179	functions that it had before the effective date of this Act.
180	180	SECTION 4. (a) The legislature validates and confirms all
181	181	governmental acts, elections, and proceedings of the Anthem
182	182	Municipal Utility District that were taken before the effective
183	183	date of this Act.
184	184	(b) This section does not apply to any matter that on the
185	185	effective date of this Act:
186	186	(1) is involved in litigation if the litigation
187	187	ultimately results in the matter being held invalid by a final court
188	188	judgment; or
189	189	(2) has been held invalid by a final court judgment.
190	190	SECTION 5. (a) The legal notice of the intention to
191	191	introduce this Act, setting forth the general substance of this
192	192	Act, has been published as provided by law, and the notice and a
193	193	copy of this Act have been furnished to all persons, agencies,
194	194	officials, or entities to which they are required to be furnished
195	195	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
196	196	Government Code.
197	197	(b) The governor, one of the required recipients, has
198	198	submitted the notice and Act to the Texas Commission on
199	199	Environmental Quality.
200	200	(c) The Texas Commission on Environmental Quality has filed
201	201	its recommendations relating to this Act with the governor, the
202	202	lieutenant governor, and the speaker of the house of
203	203	representatives within the required time.
204	204	(d) All requirements of the constitution and laws of this
205	205	state and the rules and procedures of the legislature with respect
206	206	to the notice, introduction, and passage of this Act are fulfilled
207	207	and accomplished.
208	208	SECTION 6. This Act takes effect immediately if it receives
209	209	a vote of two-thirds of all the members elected to each house, as
210	210	provided by Section 39, Article III, Texas Constitution. If this
211	211	Act does not receive the vote necessary for immediate effect, this
212	212	Act takes effect September 1, 2019.
