410 AN ACT
511 relating to the creation of the Oak Farms Municipal Management
612 District; providing authority to issue bonds; providing authority
713 to impose assessments and fees.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1016 Code, is amended by adding Chapter 3983 to read as follows:
1117 CHAPTER 3983. OAK FARMS MUNICIPAL MANAGEMENT DISTRICT
1218 SUBCHAPTER A. GENERAL PROVISIONS
1319 Sec. 3983.0101. DEFINITIONS. In this chapter:
1420 (1) "Board" means the district's board of directors.
1521 (2) "City" means the City of Dallas.
1622 (3) "Director" means a board member.
1723 (4) "District" means the Oak Farms Municipal
1824 Management District.
1925 (5) "Exempt property" means property owned by a
2026 governmental entity, including the city.
2127 Sec. 3983.0102. NATURE OF DISTRICT. The Oak Farms
2228 Municipal Management District is a special district created under
2329 Section 59, Article XVI, Texas Constitution.
2430 Sec. 3983.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2531 creation of the district is essential to accomplish the purposes of
2632 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2733 Texas Constitution, and other public purposes stated in this
2834 chapter.
2935 (b) By creating the district and in authorizing the city and
3036 other political subdivisions to contract with the district, the
3137 legislature has established a program to accomplish the public
3238 purposes set out in Section 52-a, Article III, Texas Constitution.
3339 (c) The creation of the district is necessary to promote,
3440 develop, encourage, and maintain employment, commerce,
3541 transportation, tourism, recreation, the arts, entertainment,
3642 economic development, safety, and the public welfare in the
3743 district.
3844 (d) This chapter and the creation of the district may not be
3945 interpreted to relieve the city from providing the level of
4046 services provided as of the effective date of the Act enacting this
4147 chapter to the area in the district. The district is created to
4248 supplement and not to supplant city services provided in the
4349 district.
4450 Sec. 3983.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4551 (a) All land and other property included in the district will
4652 benefit from the improvements and services to be provided by the
4753 district under powers conferred by Sections 52 and 52-a, Article
4854 III, and Section 59, Article XVI, Texas Constitution, and other
4955 powers granted under this chapter.
5056 (b) The district is created to serve a public use and
5157 benefit.
5258 (c) The creation of the district is in the public interest
5359 and is essential to further the public purposes of:
5460 (1) developing and diversifying the economy of the
5561 state;
5662 (2) eliminating unemployment and underemployment; and
5763 (3) developing or expanding transportation and
5864 commerce.
5965 (d) The district will:
6066 (1) promote the health, safety, and general welfare of
6167 residents, employers, potential employees, employees, visitors,
6268 and consumers in the district, and of the public;
6369 (2) provide needed funding for the district to
6470 preserve, maintain, and enhance the economic health and vitality of
6571 the district territory as a community and business center;
6672 (3) promote the health, safety, welfare, and enjoyment
6773 of the public by providing pedestrian ways and by landscaping and
6874 developing certain areas in the district, which are necessary for
6975 the restoration, preservation, and enhancement of scenic beauty;
7076 and
7177 (4) provide for water, wastewater, drainage, road, and
7278 recreational facilities for the district.
7379 (e) Pedestrian ways along or across a street, whether at
7480 grade or above or below the surface, and street lighting, street
7581 landscaping, parking, and street art objects are parts of and
7682 necessary components of a street and are considered to be a street
7783 or road improvement.
7884 (f) The district will not act as the agent or
7985 instrumentality of any private interest even though the district
8086 will benefit many private interests as well as the public.
8187 Sec. 3983.0105. INITIAL DISTRICT TERRITORY. (a) The
8288 district is initially composed of the territory described by
8389 Section 2 of the Act enacting this chapter.
8490 (b) The boundaries and field notes contained in Section 2 of
8591 the Act enacting this chapter form a closure. A mistake in the
8692 field notes or in copying the field notes in the legislative process
8793 does not affect the district's:
8894 (1) organization, existence, or validity;
8995 (2) right to issue any type of bonds for the purposes
9096 for which the district is created or to pay the principal of and
9197 interest on the bonds;
9298 (3) right to impose or collect an assessment; or
9399 (4) legality or operation.
94100 Sec. 3983.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
95101 All or any part of the area of the district is eligible to be
96102 included in:
97103 (1) a tax increment reinvestment zone created under
98104 Chapter 311, Tax Code; or
99105 (2) a tax abatement reinvestment zone created under
100106 Chapter 312, Tax Code.
101107 Sec. 3983.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
102108 DISTRICTS LAW. Except as otherwise provided by this chapter,
103109 Chapter 375, Local Government Code, applies to the district.
104110 Sec. 3983.0108. CONSTRUCTION OF CHAPTER. This chapter
105111 shall be liberally construed in conformity with the findings and
106112 purposes stated in this chapter.
107113 SUBCHAPTER B. BOARD OF DIRECTORS
108114 Sec. 3983.0201. GOVERNING BODY; TERMS. (a) The district is
109115 governed by a board of five elected directors who serve staggered
110116 terms of four years.
111117 (b) Directors are elected in the manner provided by
112118 Subchapter D, Chapter 49, Water Code.
113119 (c) The board may not create an executive committee to
114120 exercise the powers of the board.
115121 Sec. 3983.0202. EX OFFICIO DIRECTORS. (a) The city
116122 manager, city auditor, and city attorney serve as nonvoting ex
117123 officio directors.
118124 (b) The city manager, city auditor, or city attorney may
119125 appoint a designee to serve as an ex officio director in place of
120126 that person.
121127 (c) An ex officio director is entitled to speak on any
122128 matter before the board.
123129 (d) An ex officio director is not counted as a director for
124130 purposes of establishing a quorum.
125131 Sec. 3983.0203. MEETINGS; NOTICE. (a) The board shall hold
126132 meetings at a place accessible to the public.
127133 (b) The board must post notice of each meeting with the city
128134 secretary not later than 72 hours before the scheduled time of the
129135 meeting.
130136 Sec. 3983.0204. COMPENSATION; EXPENSES. (a) The district
131137 may compensate each voting director in an amount not to exceed $150
132138 for each board meeting. The total amount of compensation for each
133139 director in one year may not exceed $7,200.
134140 (b) An ex officio director is not entitled to receive
135141 compensation from the district.
136142 (c) A voting director or an ex officio director is entitled
137143 to reimbursement for necessary and reasonable expenses incurred in
138144 carrying out the duties and responsibilities of the board.
139145 Sec. 3983.0205. INITIAL DIRECTORS. (a) The initial board

153159 (b) Of the initial directors, the terms of directors
154160 appointed for positions one through three expire June 1, 2021, and
155161 the terms of directors appointed for positions four and five expire
156162 June 1, 2023.
157163 SUBCHAPTER C. POWERS AND DUTIES
158164 Sec. 3983.0301. GENERAL POWERS AND DUTIES. (a) The
159165 district has the powers and duties necessary to accomplish the
160166 purposes for which the district is created.
161167 (b) The board may not take any action or exercise any power
162168 granted under this chapter other than to hold an initial
163169 organizational meeting until the development agreement described
164170 by Section 3983.03011 is approved by the city and executed by the
165171 parties to the agreement.
166172 Sec. 3983.03011. DEVELOPMENT AGREEMENT. (a) The city, the
167173 district, and any other entities the city determines are necessary
168174 to the agreement may execute a development agreement if approved by
169175 the city.
170176 (b) This chapter expires on the fourth anniversary of the
171177 effective date of the Act enacting this chapter if the development
172178 agreement under Subsection (a) is not executed before that date.
173179 Sec. 3983.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
174180 district, using any money available to the district for the
175181 purpose, may provide, design, construct, acquire, improve,
176182 relocate, operate, maintain, or finance an improvement project or
177183 service authorized under this chapter or Chapter 375, Local
178184 Government Code.
179185 (b) The district may contract with a governmental or private
180186 entity to carry out an action under Subsection (a).
181187 (c) The implementation of a district project or service is a
182188 governmental function or service for the purposes of Chapter 791,
183189 Government Code.
184190 (d) A district improvement project or service must comply
185191 with:
186192 (1) the city charter and any city zoning and
187193 subdivision requirements; and
188194 (2) city codes and ordinances.
189195 (e) The district may not provide, conduct, or authorize an
190196 improvement project on any street, highway, right-of-way, or
191197 easement owned or controlled by the city unless the governing body
192198 of the city by resolution consents to the improvement.
193199 Sec. 3983.0303. NONPROFIT CORPORATION. (a) The board by
194200 resolution, with the consent of the governing body of the city by
195201 resolution, may authorize the creation of a nonprofit corporation
196202 to assist and act for the district in implementing a project or
197203 providing a service authorized by this chapter.
198204 (b) The nonprofit corporation:
199205 (1) has each power of and is considered to be a local
200206 government corporation created under Subchapter D, Chapter 431,
201207 Transportation Code; and
202208 (2) may implement any project and provide any service
203209 authorized by this chapter.
204210 (c) The board shall appoint the board of directors of the
205211 nonprofit corporation. The board of directors of the nonprofit
206212 corporation shall serve in the same manner as the board of directors
207213 of a local government corporation created under Subchapter D,
208214 Chapter 431, Transportation Code, except that a board member is not
209215 required to reside in the district.
210216 (d) The board of the nonprofit corporation shall hold
211217 meetings at a place accessible to the public.
212218 (e) The board of the nonprofit corporation must post notice
213219 of each meeting with the city secretary not later than 72 hours
214220 before the scheduled time of the meeting.
215221 Sec. 3983.0304. LAW ENFORCEMENT SERVICES. To protect the
216222 public interest, with the consent of the governing body of the city
217223 by resolution, the district may contract with a qualified party,
218224 including the city, to provide law enforcement services in the
219225 district for a fee.
220226 Sec. 3983.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
221227 The district, with the consent of the governing body of the city by
222228 resolution, may join and pay dues to a charitable or nonprofit
223229 organization that performs a service or provides an activity
224230 consistent with the furtherance of a district purpose.
225231 Sec. 3983.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
226232 district, with the consent of the governing body of the city by
227233 resolution, may engage in activities that accomplish the economic
228234 development purposes of the district.
229235 (b) The district may establish and provide for the
230236 administration of one or more programs to promote state or local
231237 economic development and to stimulate business and commercial
232238 activity in the district, including programs to:
233239 (1) make loans and grants of public money; and
234240 (2) provide district personnel and services.
235241 (c) The district may create economic development programs
236242 and exercise the economic development powers provided to
237243 municipalities by:
238244 (1) Chapter 380, Local Government Code; and
239245 (2) Subchapter A, Chapter 1509, Government Code.
240246 Sec. 3983.0307. PARKING FACILITIES. (a) The district may
241247 acquire, lease as lessor or lessee, construct, develop, own,
242248 operate, and maintain parking facilities or a system of parking
243249 facilities, including lots, garages, parking terminals, or other
244250 structures or accommodations for parking motor vehicles off the
245251 streets and related appurtenances.
246252 (b) The district's parking facilities serve the public
247253 purposes of the district and are owned, used, and held for a public
248254 purpose even if leased or operated by a private entity for a term of
249255 years.
250256 (c) The district's parking facilities are parts of and
251257 necessary components of a street and are considered to be a street
252258 or road improvement.
253259 (d) The development and operation of the district's parking
254260 facilities may be considered an economic development program.
255261 Sec. 3983.0308. ADDING OR EXCLUDING LAND. The district,
256262 with the consent of the governing body of the city by resolution,
257263 may add or exclude land in the manner provided by Subchapter J,
258264 Chapter 49, Water Code, or by Subchapter H, Chapter 54, Water Code.
259265 Sec. 3983.0309. DISBURSEMENTS AND TRANSFERS OF MONEY. The
260266 board by resolution shall establish the number of directors'
261267 signatures and the procedure required for a disbursement or
262268 transfer of district money.
263269 Sec. 3983.0310. EXEMPT PROPERTY. The district may not
264270 impose an assessment, fee, tax, or other charge on an exempt
265271 property.
266272 Sec. 3983.0311. NO AD VALOREM TAXATION. The district may
267273 not impose an ad valorem tax.
268274 Sec. 3983.0312. NO EMINENT DOMAIN POWER. The district may
269275 not exercise the power of eminent domain.
270276 SUBCHAPTER D. ASSESSMENTS
271277 Sec. 3983.0401. PETITION REQUIRED FOR FINANCING SERVICES
272278 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
273279 service or improvement project with assessments under this chapter
274280 unless a written petition requesting that service or improvement
275281 has been filed with the board.
276282 (b) A petition filed under Subsection (a) must be signed by
277283 the owners of a majority of the assessed value of real property in
278284 the district subject to assessment according to the most recent
279285 certified tax appraisal roll for the county.
280286 Sec. 3983.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
281287 The board by resolution may impose and collect an assessment for any
282288 purpose authorized by this chapter in all or any part of the
283289 district.
284290 (b) An assessment, a reassessment, or an assessment
285291 resulting from an addition to or correction of the assessment roll
286292 by the district, penalties and interest on an assessment or
287293 reassessment, an expense of collection, and reasonable attorney's
288294 fees incurred by the district:
289295 (1) are a first and prior lien against the property
290296 assessed;
291297 (2) are superior to any other lien or claim other than:
292298 (A) a lien or claim for county, school district,
293299 or municipal ad valorem taxes; or
294300 (B) a lien filed by the city or securing an
295301 obligation owed to the city; and
296302 (3) are the personal liability of and a charge against
297303 the owners of the property even if the owners are not named in the
298304 assessment proceedings.
299305 (c) The lien is effective from the date of the board's
300306 resolution imposing the assessment until the date the assessment is
301307 paid. The board may enforce the lien in the same manner that a
302308 taxing unit, as defined by Section 1.04, Tax Code, may enforce an ad
303309 valorem tax lien against real property.
304310 (d) The board may make a correction to or deletion from the
305311 assessment roll that does not increase the amount of assessment of
306312 any parcel of land without providing notice and holding a hearing in
307313 the manner required for additional assessments.
308314 SUBCHAPTER E. BONDS
309315 Sec. 3983.0501. AUTHORITY TO BORROW MONEY AND TO ISSUE
310316 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
311317 terms determined by the board.
312318 (b) The district may issue bonds, notes, or other
313319 obligations payable wholly or partly from assessments, impact fees,
314320 revenue, contract payments, grants, or other district money, or any
315321 combination of those sources of money, to pay for any authorized
316322 district purpose.
317323 Sec. 3983.0502. BONDS SECURED BY REVENUE OR CONTRACT
318324 PAYMENTS. The district may issue, without an election, bonds
319325 secured by:
320326 (1) revenue, including contract revenues; or
321327 (2) contract payments, provided that the requirements
322328 of Section 49.108, Water Code, have been met.
323329 Sec. 3983.0503. BONDS AND OTHER OBLIGATIONS FOR IMPROVEMENT
324330 UNDER AGREEMENT. If an improvement will be financed by an
325331 obligation and the obligation will be secured by the pledge of
326332 assessments, the district must enter into an agreement, which may
327333 be the development agreement, governing the financing of the
328334 improvement before the issuance of the obligation. An obligation
329335 issued under this section may be in the form of bonds, notes, or
330336 other obligations, payable wholly or partly from assessments, and
331337 may be issued, by public or private sale, in the manner provided by
332338 Subchapter A, Chapter 372, Local Government Code.
333339 Sec. 3983.0504. CONSENT OF MUNICIPALITY REQUIRED. (a) The
334340 board may not issue bonds until each municipality in whose
335341 corporate limits or extraterritorial jurisdiction the district is
336342 located has consented by ordinance or resolution to the creation of
337343 the district and to the inclusion of land in the district.
338344 (b) This section applies only to the district's first
339345 issuance of bonds.
340346 SUBCHAPTER I. DISSOLUTION
341347 Sec. 3983.0901. DISSOLUTION. (a) The board shall dissolve
342348 the district on written petition filed with the board by the owners
343349 of:
344350 (1) 66 percent or more of the assessed value of the
345351 property subject to assessment by the district based on the most
346352 recent certified county property tax rolls; or
347353 (2) 66 percent or more of the surface area of the
348354 district, excluding roads, streets, highways, utility
349355 rights-of-way, other public areas, and other property exempt from
350356 assessment by the district according to the most recent certified
351357 county property tax rolls.
352358 (b) The board by majority vote may dissolve the district at
353359 any time.
354360 (c) The city may dissolve the district at any time if:
355361 (1) the development agreement has been executed; and
356362 (2) the district's performance under the agreement has
357363 been fulfilled, including any right or obligation the district has
358364 to reimburse a developer or owner for the costs of an improvement
359365 project.
360366 (d) If the district is dissolved, the board shall transfer
361367 ownership of all district property to the city.
362368 (e) The district may not be dissolved if the district:
363369 (1) has any outstanding debt until that debt has been
364370 repaid or defeased in accordance with the order or resolution
365371 authorizing the issuance of the debt;
366372 (2) has a contractual obligation to pay money until
367373 that obligation has been fully paid in accordance with the
368374 contract; or
369375 (3) owns, operates, or maintains public works,
370376 facilities, or improvements unless the district contracts with
371377 another person for the ownership and operation or maintenance of
372378 the public works, facilities, or improvements.
373379 (f) Subchapter M, Chapter 375, Local Government Code, does
374380 not apply to the district.
375381 SECTION 2. The Oak Farms Municipal Management District
376382 initially includes all territory contained in the following area:
377383 TRACT 1:
378384 DESCRIPTION, of a 35,831 square foot (0.823 acre) tract of land
379385 situated in the Elizabeth Robertson Survey, Abstract No. 1211,
380386 Dallas County, Texas; said tract being part of Block 22, Original
381387 Town of Oak Cliff, an addition to the City of Dallas, Texas
382388 according to the plat recorded in Volume 89, Page 1 of the Deed
383389 Records of Dallas County, Texas, transcribed in Volume 3, Page 516
384390 of the Map Records of Dallas County, Texas: said tract being all of
385391 those certain tracts of land described in Special Warranty Deeds to
386392 IC PROPERTIES, LLC recorded in Instrument No. 201400176345 and
387393 201500053432 both of the Official Public Records of Dallas County,
388394 Texas; said 35,831 square foot (0.823 acre) tract being more
389395 particularly described as follows:
390396 BEGINNING, at a point for corner at the intersection of the south
391397 right-of-way line of Addison Street (a 40-foot wide right-of-way)
392398 and the east right-of-way line of North Marsalis Avenue (a 80-foot
393399 wide right-of-way);
394400 THENCE, South 89 degrees, 56 minutes, 37 seconds East, along the
395401 said south line of Addison Street, a distance of 183.75 feet to a
396402 point for corner at the intersection of said south line of Addison
397403 Street and the west line of a 20-foot wide alley dedicated on said
398404 Original Town of Oak Cliff addition;
399405 THENCE, South 00 degrees, 00 minutes, 33 seconds East, along the
400406 said west line of the 20-foot alley, a distance of 195.00 feet to a
401407 point for corner; said point being the northeast corner of that
402408 certain tract of land described in Special Warranty Deed to Tony L.
403409 Malone recorded in Volume 97108, Page 3191 of said Deed Records;
404410 THENCE, North 89 degrees, 56 minutes, 37 seconds West, departing
405411 the said west line of the 20-foot alley and along the north line of
406412 said Tony L. Malone tract, a distance of 183.75 feet to a point for
407413 corner in the said east line of North Marsalis Avenue; said point
408414 being the northwest corner of said Tony L. Malone tract;
409415 THENCE, North 00 degrees, 00 minutes, 33 seconds West, along the
410416 said east line of North Marsalis Avenue, a distance of 195.00 feet
411417 to the POINT OF BEGINNING;
412418 CONTAINING: 35,831 square feet or 0.823 acres of land, more or less.
413419 TRACT 2:
414420 DESCRIPTION, of a 1.655 acre tract of land situated in the Elizabeth
415421 Robertson Survey, Abstract No. 1211, Dallas County, Texas; said
416422 tract being part of Block 22, Original Town of Oak Cliff, an
417423 addition to the City of Dallas, Texas according to the plat recorded
418424 in Volume 89, Page 1 of the Deed Records of Dallas County, Texas,
419425 transcribed in Volume 3, Page 516 of the Map Records of Dallas
420426 County, Texas: said tract being all of those certain tracts of land
421427 described in Special Warranty Deeds to IC PROPERTIES, LLC recorded
422428 in Instrument No. 201400176705 and 201400164524, 201400177468,
423429 201400176345, 201400186992 all of the Official Public Records of
424430 Dallas County Texas; said 1.655 acre tract being more particularly
425431 described as follows:
426432 BEGINNING, at a point for corner; said point being the north end of
427433 a right-of-way corner clip at the intersection of the west
428434 right-of-way line of North Lancaster Avenue (a 60-foot wide
429435 right-of-way) and the north right-of-way line of East Colorado
430436 Boulevard (a variable width right-of-way);
431437 THENCE, South 45 degrees, 00 minutes, 06 seconds West, along said
432438 corner clip a distance of 14.14 feet to a point for corner on the
433439 said north line of said East Colorado Boulevard;

435441 following three (3) calls:
