10+ AN ACT
411 relating to the creation of the Green Tree Park Municipal Utility
512 District; granting a limited power of eminent domain; providing
613 authority to issue bonds; providing authority to impose
714 assessments, fees, and taxes.
815 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
916 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1017 Code, is amended by adding Chapter 7889 to read as follows:
1118 CHAPTER 7889. GREEN TREE PARK MUNICIPAL UTILITY DISTRICT
1219 SUBCHAPTER A. GENERAL PROVISIONS
1320 Sec. 7889.0101. DEFINITIONS. In this chapter:
1421 (1) "Board" means the district's board of directors.
1522 (2) "Commission" means the Texas Commission on
1623 Environmental Quality.
1724 (3) "Director" means a board member.
1825 (4) "District" means the Green Tree Park Municipal
1926 Utility District.
2027 Sec. 7889.0102. NATURE OF DISTRICT. The district is a
2128 municipal utility district created under Section 59, Article XVI,
2229 Texas Constitution.
2330 Sec. 7889.0103. CONFIRMATION AND DIRECTORS' ELECTION
2431 REQUIRED. The temporary directors shall hold an election to
2532 confirm the creation of the district and to elect five permanent
2633 directors as provided by Section 49.102, Water Code.
2734 Sec. 7889.0104. CONSENT OF MUNICIPALITY REQUIRED. The
2835 temporary directors may not hold an election under Section
2936 7889.0103 until each municipality in whose corporate limits or
3037 extraterritorial jurisdiction the district is located has
3138 consented by ordinance or resolution to the creation of the
3239 district and to the inclusion of land in the district.
3340 Sec. 7889.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3441 (a) The district is created to serve a public purpose and benefit.
3542 (b) The district is created to accomplish the purposes of:
3643 (1) a municipal utility district as provided by
3744 general law and Section 59, Article XVI, Texas Constitution; and
3845 (2) Section 52, Article III, Texas Constitution, that
3946 relate to the construction, acquisition, improvement, operation,
4047 or maintenance of macadamized, graveled, or paved roads, or
4148 improvements, including storm drainage, in aid of those roads.
4249 Sec. 7889.0106. INITIAL DISTRICT TERRITORY. (a) The
4350 district is initially composed of the territory described by
4451 Section 2 of the Act enacting this chapter.
4552 (b) The boundaries and field notes contained in Section 2 of
4653 the Act enacting this chapter form a closure. A mistake made in the
4754 field notes or in copying the field notes in the legislative process
4855 does not affect the district's:
4956 (1) organization, existence, or validity;
5057 (2) right to issue any type of bond for the purposes
5158 for which the district is created or to pay the principal of and
5259 interest on a bond;
5360 (3) right to impose a tax; or
5461 (4) legality or operation.
5562 SUBCHAPTER B. BOARD OF DIRECTORS
5663 Sec. 7889.0201. GOVERNING BODY; TERMS. (a) The district is
5764 governed by a board of five elected directors.
5865 (b) Except as provided by Section 7889.0202, directors
5966 serve staggered four-year terms.
6067 Sec. 7889.0202. TEMPORARY DIRECTORS. (a) On or after the
6168 effective date of the Act enacting this chapter, the owner or owners
6269 of a majority of the assessed value of the real property in the
6370 district may submit a petition to the commission requesting that
6471 the commission appoint as temporary directors the five persons
6572 named in the petition. The commission shall appoint as temporary
6673 directors the five persons named in the petition.
6774 (b) Temporary directors serve until the earlier of:
6875 (1) the date permanent directors are elected under
6976 Section 7889.0103; or
7077 (2) the fourth anniversary of the effective date of
7178 the Act enacting this chapter.
7279 (c) If permanent directors have not been elected under
7380 Section 7889.0103 and the terms of the temporary directors have
7481 expired, successor temporary directors shall be appointed or
7582 reappointed as provided by Subsection (d) to serve terms that
7683 expire on the earlier of:
7784 (1) the date permanent directors are elected under
7885 Section 7889.0103; or
7986 (2) the fourth anniversary of the date of the
8087 appointment or reappointment.
8188 (d) If Subsection (c) applies, the owner or owners of a
8289 majority of the assessed value of the real property in the district
8390 may submit a petition to the commission requesting that the
8491 commission appoint as successor temporary directors the five
8592 persons named in the petition. The commission shall appoint as
8693 successor temporary directors the five persons named in the
8794 petition.
8895 SUBCHAPTER C. POWERS AND DUTIES
8996 Sec. 7889.0301. GENERAL POWERS AND DUTIES. The district
9097 has the powers and duties necessary to accomplish the purposes for
9198 which the district is created.
9299 Sec. 7889.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
93100 DUTIES. The district has the powers and duties provided by the
94101 general law of this state, including Chapters 49 and 54, Water Code,
95102 applicable to municipal utility districts created under Section 59,
96103 Article XVI, Texas Constitution.
97104 Sec. 7889.0303. AUTHORITY FOR ROAD PROJECTS. (a) Under
98105 Section 52, Article III, Texas Constitution, the district may
99106 design, acquire, construct, finance, issue bonds for, improve, and
100107 convey to this state, a county, or a municipality for operation and
101108 maintenance macadamized, graveled, or paved roads described by
102109 Section 54.234, Water Code, or improvements, including storm
103110 drainage, in aid of those roads.
104111 (b) The district may exercise the powers provided by this
105112 section without submitting a petition to or obtaining approval from
106113 the commission as required by Section 54.234, Water Code.
107114 Sec. 7889.0304. APPROVAL OF ROAD PROJECT. (a) The district
108115 may not undertake a road project authorized by Section 7889.0303
109116 unless:
110117 (1) each municipality or county that will operate and
111118 maintain the road has approved the plans and specifications of the
112119 road project, if a municipality or county will operate and maintain
113120 the road; or
114121 (2) the Texas Transportation Commission has approved
115122 the plans and specifications of the road project, if the state will
116123 operate and maintain the road.
117124 (b) Except as provided by Subsection (a), the district is
118125 not required to obtain approval from the Texas Transportation
119126 Commission to design, acquire, construct, finance, issue bonds for,
120127 improve, or convey a road project.
121128 Sec. 7889.0305. COMPLIANCE WITH MUNICIPAL CONSENT
122129 ORDINANCE OR RESOLUTION. The district shall comply with all
123130 applicable requirements of any ordinance or resolution that is
124131 adopted under Section 54.016 or 54.0165, Water Code, and that
125132 consents to the creation of the district or to the inclusion of land
126133 in the district.
127134 Sec. 7889.0306. LIMITATION ON USE OF EMINENT DOMAIN. The
128135 district may not exercise the power of eminent domain outside the
129136 district to acquire a site or easement for:
130137 (1) a road project authorized by Section 7889.0303; or
131138 (2) a recreational facility as defined by Section
132139 49.462, Water Code.
133140 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
134141 Sec. 7889.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
135142 The district may issue, without an election, bonds and other
136143 obligations secured by:
137144 (1) revenue other than ad valorem taxes; or
138145 (2) contract payments described by Section 7889.0403.
139146 (b) The district must hold an election in the manner
140147 provided by Chapters 49 and 54, Water Code, to obtain voter approval
141148 before the district may impose an ad valorem tax or issue bonds
142149 payable from ad valorem taxes.
143150 (c) The district may not issue bonds payable from ad valorem
144151 taxes to finance a road project unless the issuance is approved by a
145152 vote of a two-thirds majority of the district voters voting at an
146153 election held for that purpose.
147154 Sec. 7889.0402. OPERATION AND MAINTENANCE TAX. (a) If
148155 authorized at an election held under Section 7889.0401, the
149156 district may impose an operation and maintenance tax on taxable
150157 property in the district in accordance with Section 49.107, Water
151158 Code.
152159 (b) The board shall determine the tax rate. The rate may not
153160 exceed the rate approved at the election.
154161 Sec. 7889.0403. CONTRACT TAXES. (a) In accordance with
155162 Section 49.108, Water Code, the district may impose a tax other than
156163 an operation and maintenance tax and use the revenue derived from
157164 the tax to make payments under a contract after the provisions of
158165 the contract have been approved by a majority of the district voters
159166 voting at an election held for that purpose.
160167 (b) A contract approved by the district voters may contain a
161168 provision stating that the contract may be modified or amended by
162169 the board without further voter approval.
163170 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
164171 Sec. 7889.0501. AUTHORITY TO ISSUE BONDS AND OTHER
165172 OBLIGATIONS. The district may issue bonds or other obligations
166173 payable wholly or partly from ad valorem taxes, impact fees,
167174 revenue, contract payments, grants, or other district money, or any
168175 combination of those sources, to pay for any authorized district
169176 purpose.
170177 Sec. 7889.0502. TAXES FOR BONDS. At the time the district
171178 issues bonds payable wholly or partly from ad valorem taxes, the
172179 board shall provide for the annual imposition of a continuing
173180 direct ad valorem tax, without limit as to rate or amount, while all
174181 or part of the bonds are outstanding as required and in the manner
175182 provided by Sections 54.601 and 54.602, Water Code.
176183 Sec. 7889.0503. BONDS FOR ROAD PROJECTS. At the time of
177184 issuance, the total principal amount of bonds or other obligations
178185 issued or incurred to finance road projects and payable from ad
179186 valorem taxes may not exceed one-fourth of the assessed value of the
180187 real property in the district.
181188 SECTION 2. The Green Tree Park Municipal Utility District
182189 initially includes all the territory contained in the following
183190 area:
184191 TRACT 1: That certain tract of land situated in Harris
185192 County, Texas, out of the SOLOMON BROWN LEAGUE, A-5, and A-7, Harris
186193 County, as described in deed from F.E. Ingram et ux, to C.T.
187194 Hackney, dated October 6, 1860, and from Oscar Hillegeist to Wm.
188195 Hillegeist, recorded in the Deed of Harris County, Texas, in Volume
189196 460, Page 461, and said tract being more particularly described as
190197 follows, to wit:
191198 From the Southwest corner of said Solomon Brown League, A-7,
192199 Harris County, Texas, GO East a distance of 2850 feet and North,
193200 crossing Waller-Tomball Road, a distance of 3403 feet to a 1 1/2
194201 inch iron pipe found for the southwest corner of the tract herein
195202 described and the POINT OF BEGINNING;
196203 THENCE, on a bearing of NORTH 00 DEGREES 49 MINUTES 55 SECONDS
197204 EAST, a distance of 7199.94 feet (called North 2450 varas or 6805.56

394401 SECTION 3. (a) The legal notice of the intention to
395402 introduce this Act, setting forth the general substance of this
396403 Act, has been published as provided by law, and the notice and a
397404 copy of this Act have been furnished to all persons, agencies,
398405 officials, or entities to which they are required to be furnished
399406 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
400407 Government Code.
401408 (b) The governor, one of the required recipients, has
402409 submitted the notice and Act to the Texas Commission on
403410 Environmental Quality.
404411 (c) The Texas Commission on Environmental Quality has filed
405412 its recommendations relating to this Act with the governor, the
406413 lieutenant governor, and the speaker of the house of
407414 representatives within the required time.
408415 (d) All requirements of the constitution and laws of this
409416 state and the rules and procedures of the legislature with respect
410417 to the notice, introduction, and passage of this Act are fulfilled
411418 and accomplished.
412419 SECTION 4. (a) Section 7889.0306, Special District Local
413420 Laws Code, as added by Section 1 of this Act, takes effect only if
414421 this Act receives a two-thirds vote of all the members elected to
415422 each house.
416423 (b) If this Act does not receive a two-thirds vote of all the
417424 members elected to each house, Subchapter C, Chapter 7889, Special
418425 District Local Laws Code, as added by Section 1 of this Act, is
419426 amended by adding Section 7889.0306 to read as follows:
420427 Sec. 7889.0306. NO EMINENT DOMAIN POWER. The district may
421428 not exercise the power of eminent domain.
422429 (c) This section is not intended to be an expression of a
423430 legislative interpretation of the requirements of Section 17(c),
424431 Article I, Texas Constitution.
425432 SECTION 5. This Act takes effect immediately if it receives
426433 a vote of two-thirds of all the members elected to each house, as
427434 provided by Section 39, Article III, Texas Constitution. If this
428435 Act does not receive the vote necessary for immediate effect, this
429436 Act takes effect September 1, 2019.
