55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a Department of Family and Protective Services plan to
88 address the substitute care capacity needs in certain department
99 regions.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 264.1261(b), Family Code, as added by
1212 Chapter 319 (S.B. 11), Acts of the 85th Legislature, Regular
1313 Session, 2017, is amended to read as follows:
1414 (b) Appropriate department management personnel from a
1515 child protective services region in which community-based care has
1616 not been implemented, in collaboration with foster care providers,
1717 faith-based entities, and child advocates in that region, shall use
1818 data collected by the department on foster care capacity needs and
1919 availability of each type of foster care and kinship placement in
2020 the region to create a plan to address the substitute care capacity
2121 needs in the region. The plan must identify:
2222 (1) [both] short-term and long-term goals and
2323 strategies for addressing those capacity needs; and
2424 (2) the capacity and geographic distribution of foster
2525 placements tailored to serve the distinct needs of pregnant and
2626 parenting youth in the conservatorship of the department.
2727 SECTION 2. Sections 264.1261(a) and (b), Family Code, as
2828 added by Chapter 822 (H.B. 1549), Acts of the 85th Legislature,
2929 Regular Session, 2017, are repealed.
3030 SECTION 3. This Act takes effect September 1, 2019.
