55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the board of directors of the Boling Municipal Water
88 District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 9018.001, Special District Local Laws
1111 Code, is amended by adding Subdivisions (1-a) and (1-b) to read as
1212 follows:
1313 (1-a) "Commission" means the Texas Commission on
1414 Environmental Quality.
1515 (1-b) "Director" means a board member.
1616 SECTION 2. Subchapter C, Chapter 9018, Special District
1717 Local Laws Code, is amended by adding Section 9018.102 to read as
1818 follows:
1919 Sec. 9018.102. TEMPORARY DIRECTORS. (a) The temporary
2020 board shall hold an election under Section 49.102, Water Code, to
2121 elect permanent directors. The temporary board consists of:
2222 (1) Brett Glenn;
2323 (2) Steve Nelson;
2424 (3) James Ezell;
2525 (4) Theodore Rangel; and
2626 (5) Bobby Charles.
2727 (b) Temporary directors serve until the earlier of:
2828 (1) the date permanent directors are elected at an
2929 election held under Section 49.102, Water Code; or
3030 (2) the fourth anniversary of the effective date of
3131 the Act enacting this section.
3232 (c) If permanent directors have not been elected at an
3333 election held under Section 49.102, Water Code, and the terms of the
3434 temporary directors have expired, successor temporary directors
3535 shall be appointed or reappointed as provided by Subsection (d) to
3636 serve terms that expire on the earlier of:
3737 (1) the date permanent directors are elected at an
3838 election held under Section 49.102, Water Code; or
3939 (2) the fourth anniversary of the date of the
4040 appointment or reappointment.
4141 (d) If Subsection (c) applies, the owner or owners of a
4242 majority of the assessed value of the real property in the district
4343 may submit a petition to the commission requesting that the
4444 commission appoint as successor temporary directors the five
4545 persons named in the petition. The commission shall appoint as
4646 successor temporary directors the five persons named in the
4747 petition.
4848 SECTION 3. The Boling Municipal Water District retains all
4949 the rights, powers, privileges, authority, duties, and functions
5050 that it had before the effective date of this Act.
5151 SECTION 4. (a) The legislature validates and confirms all
5252 governmental acts and proceedings of the Boling Municipal Water
5353 District that were taken before the effective date of this Act.
5454 (b) This section does not apply to any matter that on the
5555 effective date of this Act:
5656 (1) is involved in litigation if the litigation
5757 ultimately results in the matter being held invalid by a final court
5858 judgment; or
5959 (2) has been held invalid by a final court judgment.
6060 SECTION 5. (a) The legal notice of the intention to
6161 introduce this Act, setting forth the general substance of this
6262 Act, has been published as provided by law, and the notice and a
6363 copy of this Act have been furnished to all persons, agencies,
6464 officials, or entities to which they are required to be furnished
6565 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6666 Government Code.
6767 (b) The governor, one of the required recipients, has
6868 submitted the notice and Act to the Texas Commission on
6969 Environmental Quality.
7070 (c) The Texas Commission on Environmental Quality has filed
7171 its recommendations relating to this Act with the governor, the
7272 lieutenant governor, and the speaker of the house of
7373 representatives within the required time.
7474 (d) All requirements of the constitution and laws of this
7575 state and the rules and procedures of the legislature with respect
7676 to the notice, introduction, and passage of this Act are fulfilled
7777 and accomplished.
7878 SECTION 6. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2019.
