4	10		AN ACT
5	11		relating to the board of directors of the Boling Municipal Water
6	12		District.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 9018.001, Special District Local Laws
9	15		Code, is amended by adding Subdivisions (1-a) and (1-b) to read as
10	16		follows:
11	17		(1-a) "Commission" means the Texas Commission on
12	18		Environmental Quality.
13	19		(1-b) "Director" means a board member.
14	20		SECTION 2. Subchapter C, Chapter 9018, Special District
15	21		Local Laws Code, is amended by adding Section 9018.102 to read as
16	22		follows:
17	23		Sec. 9018.102. TEMPORARY DIRECTORS. (a) The temporary
18	24		board shall hold an election under Section 49.102, Water Code, to
19	25		elect permanent directors. The temporary board consists of:
20	26		(1) Brett Glenn;
21	27		(2) Steve Nelson;
22	28		(3) James Ezell;
23	29		(4) Theodore Rangel; and
24	30		(5) Bobby Charles.
25	31		(b) Temporary directors serve until the earlier of:
26	32		(1) the date permanent directors are elected at an
27	33		election held under Section 49.102, Water Code; or
28	34		(2) the fourth anniversary of the effective date of
29	35		the Act enacting this section.
30	36		(c) If permanent directors have not been elected at an
31	37		election held under Section 49.102, Water Code, and the terms of the
32	38		temporary directors have expired, successor temporary directors
33	39		shall be appointed or reappointed as provided by Subsection (d) to
34	40		serve terms that expire on the earlier of:
35	41		(1) the date permanent directors are elected at an
36	42		election held under Section 49.102, Water Code; or
37	43		(2) the fourth anniversary of the date of the
38	44		appointment or reappointment.
39	45		(d) If Subsection (c) applies, the owner or owners of a
40	46		majority of the assessed value of the real property in the district
41	47		may submit a petition to the commission requesting that the
42	48		commission appoint as successor temporary directors the five
43	49		persons named in the petition. The commission shall appoint as
44	50		successor temporary directors the five persons named in the
45	51		petition.
46	52		SECTION 3. The Boling Municipal Water District retains all
47	53		the rights, powers, privileges, authority, duties, and functions
48	54		that it had before the effective date of this Act.
49	55		SECTION 4. (a) The legislature validates and confirms all
50	56		governmental acts and proceedings of the Boling Municipal Water
51	57		District that were taken before the effective date of this Act.
52	58		(b) This section does not apply to any matter that on the
53	59		effective date of this Act:
54	60		(1) is involved in litigation if the litigation
55	61		ultimately results in the matter being held invalid by a final court
56	62		judgment; or
57	63		(2) has been held invalid by a final court judgment.
58	64		SECTION 5. (a) The legal notice of the intention to
59	65		introduce this Act, setting forth the general substance of this
60	66		Act, has been published as provided by law, and the notice and a
61	67		copy of this Act have been furnished to all persons, agencies,
62	68		officials, or entities to which they are required to be furnished
63	69		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
64	70		Government Code.
65	71		(b) The governor, one of the required recipients, has
66	72		submitted the notice and Act to the Texas Commission on
67	73		Environmental Quality.
68	74		(c) The Texas Commission on Environmental Quality has filed
69	75		its recommendations relating to this Act with the governor, the
70	76		lieutenant governor, and the speaker of the house of
71	77		representatives within the required time.
72	78		(d) All requirements of the constitution and laws of this
73	79		state and the rules and procedures of the legislature with respect
74	80		to the notice, introduction, and passage of this Act are fulfilled
75	81		and accomplished.
76	82		SECTION 6. This Act takes effect immediately if it receives
77	83		a vote of two-thirds of all the members elected to each house, as
78	84		provided by Section 39, Article III, Texas Constitution. If this
79	85		Act does not receive the vote necessary for immediate effect, this
80	86		Act takes effect September 1, 2019.
