6	6	AN ACT
7	7	relating to the board of directors of the Clear Lake City Water
8	8	Authority.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 9029.052, Special District Local Laws
11	11	Code, is amended to read as follows:
12	12	Sec. 9029.052. ELIGIBILITY. A person may not be appointed
13	13	or elected a director unless the person:
14	14	(1) owns taxable property in the authority; and
15	15	(2) resides in the single-member precinct the person
16	16	represents or seeks to represent [authority].
17	17	SECTION 2. Subchapter B, Chapter 9029, Special District
18	18	Local Laws Code, is amended by adding Section 9029.055 to read as
19	19	follows:
20	20	Sec. 9029.055. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER
21	21	PRECINCTS. (a) As soon as practicable after the effective date of
22	22	this section, the board shall:
23	23	(1) divide the authority into five single-member
24	24	precincts for electing directors; and
25	25	(2) assign each of the existing board positions to one
26	26	of the new single-member precincts.
27	27	(b) If the authority annexes territory, the annexed
28	28	territory becomes part of one or more of the single-member
29	29	precincts as determined by the board.
30	30	(c) One director shall be elected from each single-member
31	31	precinct.
32	32	(d) After each federal decennial census or as needed, the
33	33	board may redraw the single-member precincts to reflect population
34	34	changes. A director in office on the effective date of a change in
35	35	the boundaries of a single-member precinct, or a director elected
36	36	or appointed before the effective date of the change whose term of
37	37	office begins on or after the effective date of the change, shall
38	38	serve for the remainder of the director's term in the single-member
39	39	precinct to which elected or appointed even if the change in
40	40	boundaries places the director's residence outside the precinct to
41	41	which the director was elected or appointed.
42	42	SECTION 3. (a) The change in law made by this Act applies
43	43	only to a director elected or appointed to serve on the board of
44	44	directors of the Clear Lake City Water Authority on or after the
45	45	effective date of this Act.
46	46	(b) The change in law made by this Act does not affect the
47	47	term of office of a director serving on the board of directors of
48	48	the Clear Lake City Water Authority on the effective date of this
49	49	Act.
50	50	SECTION 4. (a) The legal notice of the intention to
51	51	introduce this Act, setting forth the general substance of this
52	52	Act, has been published as provided by law, and the notice and a
53	53	copy of this Act have been furnished to all persons, agencies,
54	54	officials, or entities to which they are required to be furnished
55	55	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
56	56	Government Code.
57	57	(b) The governor, one of the required recipients, has
58	58	submitted the notice and Act to the Texas Commission on
59	59	Environmental Quality.
60	60	(c) The Texas Commission on Environmental Quality has filed
61	61	its recommendations relating to this Act with the governor, the
62	62	lieutenant governor, and the speaker of the house of
63	63	representatives within the required time.
64	64	(d) All requirements of the constitution and laws of this
65	65	state and the rules and procedures of the legislature with respect
66	66	to the notice, introduction, and passage of this Act are fulfilled
67	67	and accomplished.
68	68	SECTION 5. This Act takes effect immediately if it receives
69	69	a vote of two-thirds of all the members elected to each house, as
70	70	provided by Section 39, Article III, Texas Constitution. If this
71	71	Act does not receive the vote necessary for immediate effect, this
72	72	Act takes effect September 1, 2019.
