55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the board of directors of the Clear Lake City Water
88 Authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 9029.052, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 9029.052. ELIGIBILITY. A person may not be appointed
1313 or elected a director unless the person:
1414 (1) owns taxable property in the authority; and
1515 (2) resides in the single-member precinct the person
1616 represents or seeks to represent [authority].
1717 SECTION 2. Subchapter B, Chapter 9029, Special District
1818 Local Laws Code, is amended by adding Section 9029.055 to read as
1919 follows:
2020 Sec. 9029.055. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER
2121 PRECINCTS. (a) As soon as practicable after the effective date of
2222 this section, the board shall:
2323 (1) divide the authority into five single-member
2424 precincts for electing directors; and
2525 (2) assign each of the existing board positions to one
2626 of the new single-member precincts.
2727 (b) If the authority annexes territory, the annexed
2828 territory becomes part of one or more of the single-member
2929 precincts as determined by the board.
3030 (c) One director shall be elected from each single-member
3131 precinct.
3232 (d) After each federal decennial census or as needed, the
3333 board may redraw the single-member precincts to reflect population
3434 changes. A director in office on the effective date of a change in
3535 the boundaries of a single-member precinct, or a director elected
3636 or appointed before the effective date of the change whose term of
3737 office begins on or after the effective date of the change, shall
3838 serve for the remainder of the director's term in the single-member
3939 precinct to which elected or appointed even if the change in
4040 boundaries places the director's residence outside the precinct to
4141 which the director was elected or appointed.
4242 SECTION 3. (a) The change in law made by this Act applies
4343 only to a director elected or appointed to serve on the board of
4444 directors of the Clear Lake City Water Authority on or after the
4545 effective date of this Act.
4646 (b) The change in law made by this Act does not affect the
4747 term of office of a director serving on the board of directors of
4848 the Clear Lake City Water Authority on the effective date of this
4949 Act.
5050 SECTION 4. (a) The legal notice of the intention to
5151 introduce this Act, setting forth the general substance of this
5252 Act, has been published as provided by law, and the notice and a
5353 copy of this Act have been furnished to all persons, agencies,
5454 officials, or entities to which they are required to be furnished
5555 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5656 Government Code.
5757 (b) The governor, one of the required recipients, has
5858 submitted the notice and Act to the Texas Commission on
5959 Environmental Quality.
6060 (c) The Texas Commission on Environmental Quality has filed
6161 its recommendations relating to this Act with the governor, the
6262 lieutenant governor, and the speaker of the house of
6363 representatives within the required time.
6464 (d) All requirements of the constitution and laws of this
6565 state and the rules and procedures of the legislature with respect
6666 to the notice, introduction, and passage of this Act are fulfilled
6767 and accomplished.
6868 SECTION 5. This Act takes effect immediately if it receives
6969 a vote of two-thirds of all the members elected to each house, as
7070 provided by Section 39, Article III, Texas Constitution. If this
7171 Act does not receive the vote necessary for immediate effect, this
7272 Act takes effect September 1, 2019.
