7 | 7 | | relating to the authority of the Midlothian Municipal Management |

8 | 8 | | District No. 3 to impose an ad valorem tax. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 3952.305, Special District Local Laws |
---|
11 | 11 | | Code, is amended to read as follows: |
---|
12 | 12 | | Sec. 3952.305. TAX RATE. (a) The district's ad valorem tax |
---|
13 | 13 | | rate may not exceed 40 cents per $100 valuation. |
---|
14 | 14 | | (b) Notwithstanding Subsection (a), the district's ad |
---|
15 | 15 | | valorem tax rate may exceed the limit specified by that subsection |
---|
16 | 16 | | to the extent necessary to permit the district to comply with |
---|
17 | 17 | | Section 3952.303. This subsection does not authorize the district |
---|
18 | 18 | | to issue bonds or other obligations if, based on the assessed value |
---|
19 | 19 | | of property in the district as shown in the most recent certificate |
---|
20 | 20 | | of assessed valuation or certificate of estimated assessed |
---|
21 | 21 | | valuation issued by the Ellis Appraisal District available at the |
---|
22 | 22 | | time of issuance, the issuance of the bonds or other obligations |
---|
23 | 23 | | would require the district to adopt a tax rate that exceeds the |
---|
24 | 24 | | limit specified by Subsection (a). |
---|
25 | 25 | | SECTION 2. (a) The legal notice of the intention to |
---|
26 | 26 | | introduce this Act, setting forth the general substance of this |
---|
27 | 27 | | Act, has been published as provided by law, and the notice and a |
---|
28 | 28 | | copy of this Act have been furnished to all persons, agencies, |
---|
29 | 29 | | officials, or entities to which they are required to be furnished |
---|
30 | 30 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
31 | 31 | | Government Code. |
---|
32 | 32 | | (b) The governor, one of the required recipients, has |
---|
33 | 33 | | submitted the notice and Act to the Texas Commission on |
---|
34 | 34 | | Environmental Quality. |
---|
35 | 35 | | (c) The Texas Commission on Environmental Quality has filed |
---|
36 | 36 | | its recommendations relating to this Act with the governor, |
---|
37 | 37 | | lieutenant governor, and speaker of the house of representatives |
---|
38 | 38 | | within the required time. |
---|
39 | 39 | | (d) All requirements of the constitution and laws of this |
---|
40 | 40 | | state and the rules and procedures of the legislature with respect |
---|
41 | 41 | | to the notice, introduction, and passage of this Act have been |
---|
42 | 42 | | fulfilled and accomplished. |
---|
43 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect September 1, 2019. |
