66 AN ACT
77 relating to the authority of the Midlothian Municipal Management
88 District No. 3 to impose an ad valorem tax.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 3952.305, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 3952.305. TAX RATE. (a) The district's ad valorem tax
1313 rate may not exceed 40 cents per $100 valuation.
1414 (b) Notwithstanding Subsection (a), the district's ad
1515 valorem tax rate may exceed the limit specified by that subsection
1616 to the extent necessary to permit the district to comply with
1717 Section 3952.303. This subsection does not authorize the district
1818 to issue bonds or other obligations if, based on the assessed value
1919 of property in the district as shown in the most recent certificate
2020 of assessed valuation or certificate of estimated assessed
2121 valuation issued by the Ellis Appraisal District available at the
2222 time of issuance, the issuance of the bonds or other obligations
2323 would require the district to adopt a tax rate that exceeds the
2424 limit specified by Subsection (a).
2525 SECTION 2. (a) The legal notice of the intention to
2626 introduce this Act, setting forth the general substance of this
2727 Act, has been published as provided by law, and the notice and a
2828 copy of this Act have been furnished to all persons, agencies,
2929 officials, or entities to which they are required to be furnished
3030 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3131 Government Code.
3232 (b) The governor, one of the required recipients, has
3333 submitted the notice and Act to the Texas Commission on
3434 Environmental Quality.
3535 (c) The Texas Commission on Environmental Quality has filed
3636 its recommendations relating to this Act with the governor,
3737 lieutenant governor, and speaker of the house of representatives
3838 within the required time.
3939 (d) All requirements of the constitution and laws of this
4040 state and the rules and procedures of the legislature with respect
4141 to the notice, introduction, and passage of this Act have been
4242 fulfilled and accomplished.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2019.
