6 | 6 | | relating to the authority of certain municipalities to pledge |

7 | 7 | | certain tax revenue for the payment of obligations related to hotel |
---|
8 | 8 | | projects. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Sections 351.102(e) and (g), Tax Code, are |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (e) In addition to the municipalities described by |
---|
13 | 13 | | Subsection (b), that subsection also applies to: |
---|
14 | 14 | | (1) a municipality with a population of at least |
---|
15 | 15 | | 110,000 but not more than 135,000 at least part of which is located |
---|
16 | 16 | | in a county with a population of not more than 135,000; |
---|
17 | 17 | | (2) a municipality with a population of at least 9,000 |
---|
18 | 18 | | but not more than 10,000 that is located in two counties, each of |
---|
19 | 19 | | which has a population of at least 662,000 and a southern border |
---|
20 | 20 | | with a county with a population of 2.3 million or more; |
---|
21 | 21 | | (3) a municipality with a population of at least |
---|
22 | 22 | | 200,000 but not more than 300,000 that contains a component |
---|
23 | 23 | | institution of the Texas Tech University System; |
---|
24 | 24 | | (4) a municipality with a population of at least |
---|
25 | 25 | | 95,000 that borders Lake Lewisville; |
---|
26 | 26 | | (5) a municipality that: |
---|
27 | 27 | | (A) contains a portion of Cedar Hill State Park; |
---|
28 | 28 | | (B) has a population of more than 45,000; |
---|
29 | 29 | | (C) is located in two counties, one of which has a |
---|
30 | 30 | | population of more than two million and one of which has a |
---|
31 | 31 | | population of more than 149,000; and |
---|
32 | 32 | | (D) has adopted a capital improvement plan for |
---|
33 | 33 | | the construction or expansion of a convention center facility; |
---|
34 | 34 | | (6) a municipality with a population of less than |
---|
35 | 35 | | 6,000 that: |
---|
36 | 36 | | (A) is located in two counties each with a |
---|
37 | 37 | | population of 600,000 or more that are both adjacent to a county |
---|
38 | 38 | | with a population of two million or more; |
---|
39 | 39 | | (B) has full-time police and fire departments; |
---|
40 | 40 | | and |
---|
41 | 41 | | (C) has adopted a capital improvement plan for |
---|
42 | 42 | | the construction or expansion of a convention center facility; |
---|
43 | 43 | | (7) a municipality with a population of at least |
---|
44 | 44 | | 56,000 that: |
---|
45 | 45 | | (A) borders Lake Ray Hubbard; and |
---|
46 | 46 | | (B) is located in two counties, one of which has a |
---|
47 | 47 | | population of less than 80,000; |
---|
48 | 48 | | (8) a municipality with a population of more than |
---|
49 | 49 | | 83,000, that borders Clear Lake, and that is primarily located in a |
---|
50 | 50 | | county with a population of less than 300,000; |
---|
51 | 51 | | (9) a municipality with a population of less than |
---|
52 | 52 | | 2,000 that: |
---|
53 | 53 | | (A) is located adjacent to a bay connected to the |
---|
54 | 54 | | Gulf of Mexico; |
---|
55 | 55 | | (B) is located in a county with a population of |
---|
56 | 56 | | 290,000 or more that is adjacent to a county with a population of |
---|
57 | 57 | | four million or more; and |
---|
58 | 58 | | (C) has a boardwalk on the bay; |
---|
59 | 59 | | (10) a municipality with a population of 75,000 or |
---|
60 | 60 | | more that: |
---|
61 | 61 | | (A) is located wholly in one county with a |
---|
62 | 62 | | population of 575,000 or more that is adjacent to a county with a |
---|
63 | 63 | | population of four million or more; and |
---|
64 | 64 | | (B) has adopted a capital improvement plan for |
---|
65 | 65 | | the construction or expansion of a convention center facility; |
---|
66 | 66 | | (11) a municipality with a population of less than |
---|
67 | 67 | | 75,000 that is located in three counties, at least one of which has |
---|
68 | 68 | | a population of at least four million; [and] |
---|
69 | 69 | | (12) an eligible coastal municipality with a |
---|
70 | 70 | | population of more than 3,000 but less than 5,000; and |
---|
71 | 71 | | (13) a municipality that is the county seat of a county |
---|
72 | 72 | | that has a population of at least 585,000 and is adjacent to a |
---|
73 | 73 | | county with a population of four million or more, except that the |
---|
74 | 74 | | municipality may also pledge revenue derived from the tax imposed |
---|
75 | 75 | | under this chapter from a hotel project that is owned by or located |
---|
76 | 76 | | on land owned by a nonprofit corporation or eleemosynary foundation |
---|
77 | 77 | | acting on behalf of or in concert with the municipality. |
---|
78 | 78 | | (g) A municipality to which this section applies may not |
---|
79 | 79 | | receive or pledge revenue or funds under Subsection (b) or (c) for a |
---|
80 | 80 | | hotel project unless the municipality enters into an agreement with |
---|
81 | 81 | | a person for the development of the hotel project before September |
---|
82 | 82 | | 1, 2021 [2019]. |
---|
83 | 83 | | SECTION 2. This Act takes effect immediately if it receives |
---|
84 | 84 | | a vote of two-thirds of all the members elected to each house, as |
---|
85 | 85 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
86 | 86 | | Act does not receive the vote necessary for immediate effect, this |
---|
87 | 87 | | Act takes effect September 1, 2019. |
