55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the classroom instruction part of the handgun
88 proficiency course taken to obtain a license to carry a handgun.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.188(b), Government Code, is amended
1111 to read as follows:
1212 (b) Only qualified handgun instructors may administer the
1313 range instruction part of the handgun proficiency course. A
1414 qualified handgun instructor or approved online course provider may
1515 administer the classroom instruction part of the handgun
1616 proficiency course. The classroom instruction part of the course
1717 must include not less than four hours and not more than six hours of
1818 instruction on:
1919 (1) the laws that relate to weapons and to the use of
2020 deadly force;
2121 (2) handgun use and safety, including:
2222 (A) types and uses of ammunition; and
2323 (B) use of restraint holsters and methods to
2424 ensure the secure carrying of openly carried handguns;
2525 (3) nonviolent dispute resolution; and
2626 (4) proper storage practices for handguns with an
2727 emphasis on storage practices that eliminate the possibility of
2828 accidental injury to a child.
2929 SECTION 2. Section 411.190(b), Government Code, is amended
3030 to read as follows:
3131 (b) In addition to the qualifications described by
3232 Subsection (a) or (a-1), as appropriate, a qualified handgun
3333 instructor or approved online course provider must be qualified to
3434 instruct persons in:
3535 (1) the laws that relate to weapons and to the use of
3636 deadly force;
3737 (2) handgun use, proficiency, and safety, including:
3838 (A) types and uses of ammunition; and
3939 (B) use of restraint holsters and methods to
4040 ensure the secure carrying of openly carried handguns;
4141 (3) nonviolent dispute resolution; and
4242 (4) proper storage practices for handguns, including
4343 storage practices that eliminate the possibility of accidental
4444 injury to a child.
4545 SECTION 3. The change in law made by this Act applies only
4646 to an application to obtain a license to carry a handgun submitted
4747 on or after the effective date of this Act. An application
4848 submitted before the effective date of this Act is governed by the
4949 law in effect on the date the application was submitted, and the
5050 former law is continued in effect for that purpose.
5151 SECTION 4. This Act takes effect September 1, 2019.
