| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 435, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Sections 435.0061, 435.0062, and |
|---|
| 11 | 11 | | 435.0063 to read as follows: |
|---|
| 12 | 12 | | Sec. 435.0061. RAW MILK AND RAW MILK PRODUCTS FOR RETAIL |
|---|
| 13 | 13 | | SALE. (a) This section does not authorize the sale of: |
|---|
| 14 | 14 | | (1) raw milk or raw milk products to or on the premises |
|---|
| 15 | 15 | | of a grocery store, supermarket, or similar retail market; |
|---|
| 16 | 16 | | (2) raw milk or raw milk products that are a blend of |
|---|
| 17 | 17 | | raw milk purchased from more than one holder of a permit issued |
|---|
| 18 | 18 | | under this chapter; or |
|---|
| 19 | 19 | | (3) raw milk or raw milk products by a person other |
|---|
| 20 | 20 | | than the permit holder or an employee or agent of the permit holder. |
|---|
| 21 | 21 | | (b) A person who holds a permit to sell raw milk or raw milk |
|---|
| 22 | 22 | | products at retail or an employee or agent of the person may sell |
|---|
| 23 | 23 | | raw milk or raw milk products directly to a consumer in this state |
|---|
| 24 | 24 | | at: |
|---|
| 25 | 25 | | (1) the person's place of business; |
|---|
| 26 | 26 | | (2) the consumer's residence; or |
|---|
| 27 | 27 | | (3) a farmers' market as defined by Section 437.020. |
|---|
| 28 | 28 | | (c) A person who sells raw milk or raw milk products under |
|---|
| 29 | 29 | | this section shall maintain the raw milk or raw milk products in |
|---|
| 30 | 30 | | compliance with Section 435.0063. |
|---|
| 31 | 31 | | (d) A person who sells raw milk or raw milk products under |
|---|
| 32 | 32 | | this section shall affix to each raw milk or raw milk product |
|---|
| 33 | 33 | | container a label that includes: |
|---|
| 34 | 34 | | (1) the person's name or business name; |
|---|
| 35 | 35 | | (2) the person's permit number; |
|---|
| 36 | 36 | | (3) the calendar date the raw milk or raw milk product |
|---|
| 37 | 37 | | was placed in the container; and |
|---|
| 38 | 38 | | (4) the following statement: "This product contains |
|---|
| 39 | 39 | | unpasteurized milk. Consuming raw foods, including raw dairy |
|---|
| 40 | 40 | | products, may increase your risk of food-borne illness. Persons at |
|---|
| 41 | 41 | | higher risk for food-borne illness include pregnant and nursing |
|---|
| 42 | 42 | | women, children, the elderly, and people with weakened immune |
|---|
| 43 | 43 | | systems." |
|---|
| 44 | 44 | | Sec. 435.0062. AVAILABILITY OF RECORDS ON RAW MILK TESTING. |
|---|
| 45 | 45 | | The department on request shall provide the requestor with a record |
|---|
| 46 | 46 | | of test results from an inspection of raw milk or raw milk products |
|---|
| 47 | 47 | | conducted under Section 435.004 or 435.005. |
|---|
| 48 | 48 | | Sec. 435.0063. HANDLING AND TRANSPORTING RAW MILK AND RAW |
|---|
| 49 | 49 | | MILK PRODUCTS FOR RETAIL SALE. (a) A person who produces raw milk |
|---|
| 50 | 50 | | or raw milk products for retail sale under this chapter shall: |
|---|
| 51 | 51 | | (1) place the raw milk or raw milk products in an |
|---|
| 52 | 52 | | aseptic or single-use container; and |
|---|
| 53 | 53 | | (2) sell the raw milk or raw milk products not later |
|---|
| 54 | 54 | | than the fifth day after the date the container is filled, unless |
|---|
| 55 | 55 | | the raw milk or raw milk product is frozen and remains frozen until |
|---|
| 56 | 56 | | sold. |
|---|
| 57 | 57 | | (b) A producer or other person who transports raw milk or |
|---|
| 58 | 58 | | raw milk products for delivery shall: |
|---|
| 59 | 59 | | (1) maintain the raw milk or raw milk products in air |
|---|
| 60 | 60 | | temperatures at or below 41 degrees Fahrenheit; and |
|---|
| 61 | 61 | | (2) protect the raw milk or raw milk products from |
|---|
| 62 | 62 | | exposure to direct sunlight. |
|---|
| 63 | 63 | | (c) The department or a local health authority may not |
|---|
| 64 | 64 | | mandate the specific method for complying with a temperature |
|---|
| 65 | 65 | | requirement under Subsection (b). |
|---|
| 66 | 66 | | (d) A producer may contract with another person to transport |
|---|
| 67 | 67 | | and deliver raw milk or raw milk products in accordance with this |
|---|
| 68 | 68 | | section. The producer is jointly and severally liable for |
|---|
| 69 | 69 | | transport and delivery of raw milk or raw milk products not |
|---|
| 70 | 70 | | conducted in accordance with this chapter and department rules. |
|---|
| 71 | 71 | | SECTION 2. Section 435.013, Health and Safety Code, is |
|---|
| 72 | 72 | | repealed. |
|---|
| 73 | 73 | | SECTION 3. This Act takes effect September 1, 2019. |
