66 AN ACT
77 relating to the regulation of raw milk and raw milk products.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 435, Health and Safety
1010 Code, is amended by adding Sections 435.0061, 435.0062, and
1111 435.0063 to read as follows:
1212 Sec. 435.0061. RAW MILK AND RAW MILK PRODUCTS FOR RETAIL
1313 SALE. (a) This section does not authorize the sale of:
1414 (1) raw milk or raw milk products to or on the premises
1515 of a grocery store, supermarket, or similar retail market;
1616 (2) raw milk or raw milk products that are a blend of
1717 raw milk purchased from more than one holder of a permit issued
1818 under this chapter; or
1919 (3) raw milk or raw milk products by a person other
2020 than the permit holder or an employee or agent of the permit holder.
2121 (b) A person who holds a permit to sell raw milk or raw milk
2222 products at retail or an employee or agent of the person may sell
2323 raw milk or raw milk products directly to a consumer in this state
2424 at:
2525 (1) the person's place of business;
2626 (2) the consumer's residence; or
2727 (3) a farmers' market as defined by Section 437.020.
2828 (c) A person who sells raw milk or raw milk products under
2929 this section shall maintain the raw milk or raw milk products in
3030 compliance with Section 435.0063.
3131 (d) A person who sells raw milk or raw milk products under
3232 this section shall affix to each raw milk or raw milk product
3333 container a label that includes:
3434 (1) the person's name or business name;
3535 (2) the person's permit number;
3636 (3) the calendar date the raw milk or raw milk product
3737 was placed in the container; and
3838 (4) the following statement: "This product contains
3939 unpasteurized milk. Consuming raw foods, including raw dairy
4040 products, may increase your risk of food-borne illness. Persons at
4141 higher risk for food-borne illness include pregnant and nursing
4242 women, children, the elderly, and people with weakened immune
4343 systems."
4444 Sec. 435.0062. AVAILABILITY OF RECORDS ON RAW MILK TESTING.
4545 The department on request shall provide the requestor with a record
4646 of test results from an inspection of raw milk or raw milk products
4747 conducted under Section 435.004 or 435.005.
4848 Sec. 435.0063. HANDLING AND TRANSPORTING RAW MILK AND RAW
4949 MILK PRODUCTS FOR RETAIL SALE. (a) A person who produces raw milk
5050 or raw milk products for retail sale under this chapter shall:
5151 (1) place the raw milk or raw milk products in an
5252 aseptic or single-use container; and
5353 (2) sell the raw milk or raw milk products not later
5454 than the fifth day after the date the container is filled, unless
5555 the raw milk or raw milk product is frozen and remains frozen until
5656 sold.
5757 (b) A producer or other person who transports raw milk or
5858 raw milk products for delivery shall:
5959 (1) maintain the raw milk or raw milk products in air
6060 temperatures at or below 41 degrees Fahrenheit; and
6161 (2) protect the raw milk or raw milk products from
6262 exposure to direct sunlight.
6363 (c) The department or a local health authority may not
6464 mandate the specific method for complying with a temperature
6565 requirement under Subsection (b).
6666 (d) A producer may contract with another person to transport
6767 and deliver raw milk or raw milk products in accordance with this
6868 section. The producer is jointly and severally liable for
6969 transport and delivery of raw milk or raw milk products not
7070 conducted in accordance with this chapter and department rules.
7171 SECTION 2. Section 435.013, Health and Safety Code, is
7272 repealed.
7373 SECTION 3. This Act takes effect September 1, 2019.
