| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 361.0961, Health and Safety Code, is | |
| 12 | 12 | amended by adding Subsection (d) to read as follows: | |
| 13 | 13 | (d) In this section, "container or package" does not include | |
| 14 | 14 | a single-use bag provided by a retail business to a customer at the | |
| 15 | 15 | point of sale for the purpose of transporting purchases. | |
| 16 | 16 | SECTION 2. The change in law made by this Act is intended | |
| 17 | 17 | only to clarify existing law with respect to local government | |
| 18 | 18 | prohibitions or restrictions on the sale or use of a container or | |
| 19 | 19 | package. | |
| 20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2019. |
