55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the limitation on administration and use of certain
88 assessment instruments in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.023, Education Code, is amended by
1111 amending Subsections (a), (c), and (c-3) and adding Subsection (q)
1212 to read as follows:
1313 (a) The agency shall adopt or develop appropriate
1414 criterion-referenced assessment instruments designed to assess
1515 essential knowledge and skills in reading, [writing,] mathematics,
1616 [social studies,] and science. Except as provided by Subsection
1717 (a-2), all students, other than students assessed under Subsection
1818 (b) or (l) or exempted under Section 39.027, shall be assessed in:
1919 (1) mathematics, annually in grades three through
2020 seven without the aid of technology and in grade eight with the aid
2121 of technology on any assessment instrument that includes algebra;
2222 (2) reading, annually in grades three through eight;
2323 and
2424 (3) [writing, including spelling and grammar, in
2525 grades four and seven;
2626 [(4) social studies, in grade eight;
2727 [(5)] science, in grades five and eight[; and
2828 [(6) any other subject and grade required by federal
2929 law].
3030 (c) The agency shall also adopt end-of-course assessment
3131 instruments for secondary-level courses in Algebra I, biology, and
3232 English I[, English II, and United States history]. The Algebra I
3333 end-of-course assessment instrument must be administered with the
3434 aid of technology. The English I [and English II] end-of-course
3535 assessment instrument [instruments] must [each] assess essential
3636 knowledge and skills in both reading and writing in the same
3737 assessment instrument and must provide a single score. A school
3838 district shall comply with State Board of Education rules regarding
3939 administration of the assessment instruments listed in this
4040 subsection. If a student is in a special education program under
4141 Subchapter A, Chapter 29, the student's admission, review, and
4242 dismissal committee shall determine whether any allowable
4343 modification is necessary in administering to the student an
4444 assessment instrument required under this subsection. The State
4545 Board of Education shall administer the assessment instruments.
4646 The State Board of Education shall adopt a schedule for the
4747 administration of end-of-course assessment instruments that
4848 complies with the requirements of Subsection (c-3).
4949 (c-3) In adopting a schedule for the administration of
5050 assessment instruments under this section, the State Board of
5151 Education shall require:
5252 (1) assessment instruments administered under
5353 Subsection (a) to be administered on a schedule so that the first
5454 assessment instrument is administered at least two weeks later than
5555 the date on which the first assessment instrument was administered
5656 under Subsection (a) during the 2006-2007 school year; and
5757 (2) the spring administration of end-of-course
5858 assessment instruments under Subsection (c) to occur in each school
5959 district not earlier than the first full week in May, except that
6060 the spring administration of the end-of-course assessment
6161 instrument [instruments] in English I [and English II] must be
6262 permitted to occur at an earlier date.
6363 (q) This subsection applies to assessment instruments
6464 adopted or developed under Subsection (a) to assess writing in
6565 grades four and seven, an assessment instrument adopted or
6666 developed under Subsection (a) to assess social studies in grade
6767 eight, and end-of-course assessments adopted under Subsection (c)
6868 for secondary-level courses in English II and United States
6969 history, as those subsections existed before amendment by __.B.
7070 No.___, Acts of the 86th Legislature, Regular Session, 2019. The
7171 agency may retain assessment instruments described by this
7272 subsection, but may not require a school district to administer
7373 those assessment instruments. A school district may choose to
7474 administer an assessment instrument described by this subsection.
7575 An assessment instrument described by this subsection administered
7676 by a school district may not be used for accountability purposes to
7777 measure the performance of the district or a district campus.
7878 SECTION 2. Section 39.025(a-1), Education Code, is amended
7979 to read as follows:
8080 (a-1) A student enrolled in a college preparatory
8181 mathematics or English language arts course under Section 28.014
8282 who satisfies the Texas Success Initiative (TSI) college readiness
8383 benchmarks prescribed by the Texas Higher Education Coordinating
8484 Board under Section 51.334 on an assessment instrument designated
8585 by the coordinating board under that section administered at the
8686 end of the college preparatory mathematics or English language arts
8787 course satisfies the requirements concerning and is exempt from the
8888 administration of the Algebra I or the English I [and English II]
8989 end-of-course assessment instrument [instruments], as applicable,
9090 as prescribed by Section 39.023(c), even if the student did not
9191 perform satisfactorily on a previous administration of the
9292 applicable end-of-course assessment instrument. A student who
9393 fails to perform satisfactorily on the assessment instrument
9494 designated by the coordinating board under Section 51.334
9595 administered as provided by this subsection may retake that
9696 assessment instrument for purposes of this subsection or may take
9797 the appropriate end-of-course assessment instrument.
9898 SECTION 3. Section 39.203(c), Education Code, is amended to
9999 read as follows:
100100 (c) In addition to the distinction designations described
101101 by Subsections (a) and (b), a campus that satisfies the criteria
102102 developed under Section 39.204 shall be awarded a distinction
103103 designation by the commissioner for outstanding performance in
104104 academic achievement in English language arts, mathematics, or
105105 science[, or social studies].
106106 SECTION 4. This Act applies beginning with the 2019-2020
107107 school year.
108108 SECTION 5. This Act takes effect immediately if it receives
109109 a vote of two-thirds of all the members elected to each house, as
110110 provided by Section 39, Article III, Texas Constitution. If this
111111 Act does not receive the vote necessary for immediate effect, this
112112 Act takes effect September 1, 2019.
