44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the authority of certain municipalities to pledge
77 certain tax revenue for the payment of obligations related to hotel
88 projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 351.102(e) and (g), Tax Code, are
1111 amended to read as follows:
1212 (e) In addition to the municipalities described by
1313 Subsection (b), that subsection also applies to:
1414 (1) a municipality with a population of at least
1515 110,000 but not more than 135,000 at least part of which is located
1616 in a county with a population of not more than 135,000;
1717 (2) a municipality with a population of at least 9,000
1818 but not more than 10,000 that is located in two counties, each of
1919 which has a population of at least 662,000 and a southern border
2020 with a county with a population of 2.3 million or more;
2121 (3) a municipality with a population of at least
2222 200,000 but not more than 300,000 that contains a component
2323 institution of the Texas Tech University System;
2424 (4) a municipality with a population of at least
2525 95,000 that borders Lake Lewisville;
2626 (5) a municipality that:
2727 (A) contains a portion of Cedar Hill State Park;
2828 (B) has a population of more than 45,000;
2929 (C) is located in two counties, one of which has a
3030 population of more than two million and one of which has a
3131 population of more than 149,000; and
3232 (D) has adopted a capital improvement plan for
3333 the construction or expansion of a convention center facility;
3434 (6) a municipality with a population of less than
3535 6,000 that:
3636 (A) is located in two counties each with a
3737 population of 600,000 or more that are both adjacent to a county
3838 with a population of two million or more;
3939 (B) has full-time police and fire departments;
4040 and
4141 (C) has adopted a capital improvement plan for
4242 the construction or expansion of a convention center facility;
4343 (7) a municipality with a population of at least
4444 56,000 that:
4545 (A) borders Lake Ray Hubbard; and
4646 (B) is located in two counties, one of which has a
4747 population of less than 80,000;
4848 (8) a municipality with a population of more than
4949 83,000, that borders Clear Lake, and that is primarily located in a
5050 county with a population of less than 300,000;
5151 (9) a municipality with a population of less than
5252 2,000 that:
5353 (A) is located adjacent to a bay connected to the
5454 Gulf of Mexico;
5555 (B) is located in a county with a population of
5656 290,000 or more that is adjacent to a county with a population of
5757 four million or more; and
5858 (C) has a boardwalk on the bay;
5959 (10) a municipality with a population of 75,000 or
6060 more that:
6161 (A) is located wholly in one county with a
6262 population of 575,000 or more that is adjacent to a county with a
6363 population of four million or more; and
6464 (B) has adopted a capital improvement plan for
6565 the construction or expansion of a convention center facility;
6666 (11) a municipality with a population of less than
6767 75,000 that is located in three counties, at least one of which has
6868 a population of at least four million; [and]
6969 (12) an eligible coastal municipality with a
7070 population of more than 3,000 but less than 5,000; and
7171 (13) a municipality that is the county seat of a county
7272 that has a population of at least 585,000 and is adjacent to a
7373 county with a population of four million or more.
7474 (g) A municipality to which this section applies may not
7575 receive or pledge revenue or funds under Subsection (b) or (c) for a
7676 hotel project unless the municipality enters into an agreement with
7777 a person for the development of the hotel project before September
7878 1, 2021 [2019].
7979 SECTION 2. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2019.
