| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 552.111, Government Code, is amended to | |
| 12 | 12 | read as follows: | |
| 13 | 13 | Sec. 552.111. EXCEPTION: AGENCY MEMORANDA. (a) Except as | |
| 14 | 14 | provided by Subsection (b), an [An] interagency or intraagency | |
| 15 | 15 | memorandum or letter that would not be available by law to a party | |
| 16 | 16 | in litigation with the agency is excepted from the requirements of | |
| 17 | 17 | Section 552.021. | |
| 18 | 18 | (b) The exception to disclosure provided by Subsection (a) | |
| 19 | 19 | does not apply to a draft grant application prepared by or for a | |
| 20 | 20 | state agency or governmental entity with taxing authority after: | |
| 21 | 21 | (1) the state agency or governmental entity with | |
| 22 | 22 | taxing authority submits the grant application; | |
| 23 | 23 | (2) the state agency or governmental entity with | |
| 24 | 24 | taxing authority determines it will not submit the grant | |
| 25 | 25 | application; or | |
| 26 | 26 | (3) the deadline to submit the grant application has | |
| 27 | 27 | passed. | |
| 28 | 28 | SECTION 2. The changes in law made by this Act apply only to | |
| 29 | 29 | a request for information received by a governmental body or an | |
| 30 | 30 | officer for public information on or after the effective date of | |
| 31 | 31 | this Act. A request for information received before the effective | |
| 32 | 32 | date of this Act is governed by the law in effect on the date the | |
| 33 | 33 | request was received, and the former law is continued in effect for | |
| 34 | 34 | that purpose. | |
| 35 | 35 | SECTION 3. This Act takes effect September 1, 2019. |
