66 AN ACT
77 relating to the applicability to certain draft grant applications
88 of the exception from disclosure under the public information law
99 for agency memoranda.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 552.111, Government Code, is amended to
1212 read as follows:
1313 Sec. 552.111. EXCEPTION: AGENCY MEMORANDA. (a) Except as
1414 provided by Subsection (b), an [An] interagency or intraagency
1515 memorandum or letter that would not be available by law to a party
1616 in litigation with the agency is excepted from the requirements of
1717 Section 552.021.
1818 (b) The exception to disclosure provided by Subsection (a)
1919 does not apply to a draft grant application prepared by or for a
2020 state agency or governmental entity with taxing authority after:
2121 (1) the state agency or governmental entity with
2222 taxing authority submits the grant application;
2323 (2) the state agency or governmental entity with
2424 taxing authority determines it will not submit the grant
2525 application; or
2626 (3) the deadline to submit the grant application has
2727 passed.
2828 SECTION 2. The changes in law made by this Act apply only to
2929 a request for information received by a governmental body or an
3030 officer for public information on or after the effective date of
3131 this Act. A request for information received before the effective
3232 date of this Act is governed by the law in effect on the date the
3333 request was received, and the former law is continued in effect for
3434 that purpose.
3535 SECTION 3. This Act takes effect September 1, 2019.
