410 AN ACT
511 relating to verification of hunting and fishing license
612 information.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 42.006, Parks and Wildlife Code, is
915 amended to read as follows:
1016 Sec. 42.006. POSSESSION OF LICENSE;[:] RULES. (a) The
1117 commission by rule may prescribe requirements relating to
1218 possessing a license issued under this chapter.
1319 (b) Rules adopted under Subsection (a) must allow for a
1420 person to present for the purpose of verification of possession a
1521 hunting license as an image displayed on a wireless communication
1622 device. The image displayed may be either an image of information
1723 from the Internet website of the department or a photograph of a
1824 hunting license.
1925 (c) The display of an image that includes hunting license
2026 information on a wireless communication device under this section
2127 does not constitute effective consent for a law enforcement
2228 officer, or any other person, to access the contents of the wireless
2329 communication device except to view the hunting license
2430 information.
2531 (d) The authorization of the use of a wireless communication
2632 device to display hunting license information under Subsection (b)
2733 does not prevent a court of competent jurisdiction from requiring a
2834 person to provide a paper copy of the person's hunting license in a
2935 hearing or trial or in connection with discovery proceedings.
3036 (e) A telecommunications provider, as defined by Section
3137 51.002, Utilities Code, may not be held liable to the holder of a
3238 hunting license for the failure of a wireless communication device
3339 to display hunting license information under Subsection (b).
3440 SECTION 2. Section 46.0085, Parks and Wildlife Code, is
3541 amended by adding Subsections (d), (e), (f), and (g) to read as
3642 follows:
3743 (d) Rules adopted under Subsection (a) must allow for a
3844 person to present for the purpose of verification of possession a
3945 fishing license as an image displayed on a wireless communication
4046 device. The image displayed may be either an image of information
4147 from the Internet website of the department or a photograph of a
4248 fishing license.
4349 (e) The display of an image that includes fishing license
4450 information on a wireless communication device under this section
4551 does not constitute effective consent for a law enforcement
4652 officer, or any other person, to access the contents of the wireless
4753 communication device except to view the fishing license
4854 information.
4955 (f) The authorization of the use of a wireless communication
5056 device to display fishing license information under Subsection (d)
5157 does not prevent a court of competent jurisdiction from requiring a
5258 person to provide a paper copy of the person's fishing license in a
5359 hearing or trial or in connection with discovery proceedings.
5460 (g) A telecommunications provider, as defined by Section
5561 51.002, Utilities Code, may not be held liable to the holder of a
5662 fishing license for the failure of a wireless communication device
5763 to display fishing license information under Subsection (d).
5864 SECTION 3. Section 50.004, Parks and Wildlife Code, is
5965 amended by adding Subsections (c), (d), (e), and (f) to read as
6066 follows:
6167 (c) Rules adopted under Subsection (a) must allow for a
6268 person to present for the purpose of verification of possession a
6369 combination hunting and fishing license as an image displayed on a
6470 wireless communication device. The image displayed may be either an
6571 image of information from the Internet website of the department or
6672 a photograph of a combination hunting and fishing license.
6773 (d) The display of an image that includes combination
6874 hunting and fishing license information on a wireless communication
6975 device under this section does not constitute effective consent for
7076 a law enforcement officer, or any other person, to access the
7177 contents of the wireless communication device except to view the
7278 combination hunting and fishing license information.
7379 (e) The authorization of the use of a wireless communication
7480 device to display combination hunting and fishing license
7581 information under Subsection (c) does not prevent a court of
7682 competent jurisdiction from requiring a person to provide a paper
7783 copy of the person's combination hunting and fishing license in a
7884 hearing or trial or in connection with discovery proceedings.
7985 (f) A telecommunications provider, as defined by Section
8086 51.002, Utilities Code, may not be held liable to the holder of a
8187 combination hunting and fishing license for the failure of a
8288 wireless communication device to display combination hunting and
8389 fishing license information under Subsection (c).
8490 SECTION 4. This Act takes effect September 1, 2019.
