55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an objection to the judge assigned in a criminal case.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 74.053(b), Government Code, is amended
1010 to read as follows:
1111 (b) If a party to a civil or criminal case files a timely
1212 objection to the assignment, the judge shall not hear the case.
1313 Except as provided by Subsection (d), each party to the case is only
1414 entitled to one objection under this section for that case.
1515 SECTION 2. The change in law made by this Act applies only
1616 to the right to object to the assignment of a judge assigned under
1717 Chapter 74, Government Code, on or after the effective date of this
1818 Act. An objection to the assignment of a judge assigned under
1919 Chapter 74, Government Code, before the effective date of this Act
2020 is governed by the law in effect on the date of assignment, and the
2121 former law is continued in effect for that purpose.
2222 SECTION 3. This Act takes effect September 1, 2019.
