410 AN ACT
511 relating to written agreements incident to divorce or annulment.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 7.006(b), Family Code, is amended to
814 read as follows:
915 (b) If the court finds that the terms of the written
1016 agreement in a divorce or an annulment are just and right, those
1117 terms are binding on the court. If the court approves the
1218 agreement, the court may set forth the agreement in full or
1319 incorporate the agreement by reference in the final decree. If the
1420 court incorporates the agreement by reference in the final decree,
1521 the agreement is not required to be filed with the court or the
1622 court clerk.
1723 SECTION 2. Section 7.006(b), Family Code, as amended by
1824 this Act, applies to an agreement incorporated by reference in a
1925 final decree of divorce or annulment regardless of whether the
2026 decree is signed before, on, or after the effective date of this
2127 Act.
2228 SECTION 3. This Act takes effect immediately if it receives
2329 a vote of two-thirds of all the members elected to each house, as
2430 provided by Section 39, Article III, Texas Constitution. If this
2531 Act does not receive the vote necessary for immediate effect, this
2632 Act takes effect September 1, 2019.
