| 6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 13 | | SECTION 1. Section 7.006(b), Family Code, is amended to |
|---|
| 8 | 14 | | read as follows: |
|---|
| 9 | 15 | | (b) If the court finds that the terms of the written |
|---|
| 10 | 16 | | agreement in a divorce or an annulment are just and right, those |
|---|
| 11 | 17 | | terms are binding on the court. If the court approves the |
|---|
| 12 | 18 | | agreement, the court may set forth the agreement in full or |
|---|
| 13 | 19 | | incorporate the agreement by reference in the final decree. If the |
|---|
| 14 | 20 | | court incorporates the agreement by reference in the final decree, |
|---|
| 15 | 21 | | the agreement is not required to be filed with the court or the |
|---|
| 16 | 22 | | court clerk. |

| 17 | 23 | | SECTION 2. Section 7.006(b), Family Code, as amended by |
|---|
| 18 | 24 | | this Act, applies to an agreement incorporated by reference in a |
|---|
| 19 | 25 | | final decree of divorce or annulment regardless of whether the |
|---|
| 20 | 26 | | decree is signed before, on, or after the effective date of this |
|---|
| 21 | 27 | | Act. |
|---|
| 22 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 23 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 32 | | Act takes effect September 1, 2019. |
