55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of certain criminal defendants for an
88 order of nondisclosure of criminal history record information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E-1, Chapter 411, Government Code, is
1111 amended by adding Section 411.0726 to read as follows:
1212 Sec. 411.0726. PROCEDURE FOR CERTAIN CHARGED OFFENSES NOT
1313 RESULTING IN CONVICTION OR DEFERRED ADJUDICATION. (a) This
1414 section applies only to a person who is:
1515 (1) charged with more than one offense arising out of
1616 the same criminal episode;
1717 (2) convicted of or placed on deferred adjudication
1818 community supervision for at least one but not all of the offenses
1919 charged; and
2020 (3) charged with another offense arising out of that
2121 criminal episode that:
2222 (A) resulted in acquittal; or
2323 (B) is dismissed by the court or the attorney
2424 representing the state.
2525 (b) Notwithstanding any other provision of this subchapter
2626 or Subchapter F, a person described by Subsection (a) who satisfies
2727 the requirements of this section may petition the court with
2828 jurisdiction over the offense described by Subsection (a)(2) for an
2929 order of nondisclosure of criminal history record information under
3030 this section with respect to an offense described by Subsection
3131 (a)(3).
3232 (c) After notice to the state, an opportunity for a hearing,
3333 and a determination that the person is entitled to file the petition
3434 and issuance of the order is in the best interest of justice, the
3535 court shall issue an order prohibiting criminal justice agencies
3636 from disclosing to the public criminal history record information
3737 related to an offense described by Subsection (a)(3).
3838 (d) A person may petition the court with jurisdiction over
3939 the offense described by Subsection (a)(2) for an order of
4040 nondisclosure of criminal history record information under this
4141 section with respect to an offense described by Subsection (a)(3)
4242 only on or after the second anniversary of the date on which, for
4343 all offenses described by Subsection (a)(2), the person is fully
4444 discharged from the person's sentence or has successfully completed
4545 the person's term of deferred adjudication community supervision,
4646 as applicable.
4747 (e) A person is entitled to petition the court to receive an
4848 order of nondisclosure of criminal history record information
4949 under this section only if, during the period after the court
5050 pronounced the sentence or placed the person on community
5151 supervision, including deferred adjudication community
5252 supervision, and during the waiting period required by Subsection
5353 (d), the person is not convicted of or placed on deferred
5454 adjudication community supervision under Subchapter C, Chapter
5555 42A, Code of Criminal Procedure, for any offense other than a
5656 traffic offense that is punishable by fine only.
5757 (f) A person may not be granted an order of nondisclosure of
5858 criminal history record information under this section and is not
5959 entitled to petition the court for an order under this section if,
6060 as described by Subsection (a)(2) or at any time before the petition
6161 is filed, the person has been convicted of or placed on deferred
6262 adjudication community supervision for:
6363 (1) an offense requiring registration as a sex
6464 offender under Chapter 62, Code of Criminal Procedure;
6565 (2) an offense under Section 20.04, Penal Code,
6666 regardless of whether the offense is a reportable conviction or
6767 adjudication for purposes of Chapter 62, Code of Criminal
6868 Procedure;
6969 (3) an offense under Section 19.02, 19.03, 20A.02,
7070 20A.03, 22.04, 22.041, 25.07, 25.072, or 42.072, Penal Code; or
7171 (4) any other offense involving family violence, as
7272 defined by Section 71.004, Family Code.
7373 SECTION 2. Section 411.074, Government Code, is amended by
7474 adding Subsection (c) to read as follows:
7575 (c) This section does not apply to an order of nondisclosure
7676 of criminal history record information under Section 411.0726.
7777 SECTION 3. Section 411.0726, Government Code, as added by
7878 this Act, applies to a person who petitions the court for an order
7979 of nondisclosure of criminal history record information on or after
8080 the effective date of this Act, regardless of whether the charged
8181 offense that is the subject of the petition was allegedly committed
8282 before, on, or after the effective date of this Act.
8383 SECTION 4. This Act takes effect September 1, 2019.
