55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the restoration of certain rights to a criminal
88 defendant.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 48.05(a)(2), Code of Criminal Procedure,
1111 is amended to read as follows:
1212 (2) This article applies to:
1313 (A) a federal offense, other than an offense
1414 involving:
1515 (i) violence or the threat of violence;
1616 (ii) drugs; or
1717 (iii) firearms; [and]
1818 (B) an offense under the laws of another country,
1919 other than an offense involving:
2020 (i) violence or the threat of violence;
2121 (ii) drugs; or
2222 (iii) firearms, if the elements of the
2323 offense are substantially similar to elements of an offense under
2424 the laws of this state punishable as a felony; and
2525 (C) any offense under the laws of this state.
2626 SECTION 2. Article 48.05(b), Code of Criminal Procedure, is
2727 amended to read as follows:
2828 (b) An individual may not apply for restoration of civil
2929 rights under this article unless:
3030 (1) the individual has completed the sentence for the
3131 offense;
3232 (2) the conviction occurred[:
3333 [(A)] three or more years before the date of
3434 application[, if the offense is a federal offense; or
3535 [(B) two or more years before the date of
3636 application, if the offense is an offense under the laws of another
3737 country]; and
3838 (3) the individual has not been convicted at any other
3939 time of an offense under the laws of this state, another state, or
4040 the United States.
4141 SECTION 3. This Act applies to a defendant who is convicted
4242 of an offense before, on, or after the effective date of this Act.
4343 SECTION 4. This Act takes effect September 1, 2019.
