| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 815.003, Government Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (b) Two of the elected members [To be eligible to serve as an |
|---|
| 14 | 14 | | elected member] of the board[, a person] must be members [a member] |
|---|
| 15 | 15 | | of the retirement system and must hold positions [a position] that: |
|---|
| 16 | 16 | | (1) are [is] included in the employee class of |
|---|
| 17 | 17 | | membership; and |
|---|
| 18 | 18 | | (2) are [is] not with an agency or department with |
|---|
| 19 | 19 | | which another trustee holds a position. |
|---|
| 20 | 20 | | (b-1) The third elected member of the board must: |
|---|
| 21 | 21 | | (1) meet the requirements of Subsection (b); or |
|---|
| 22 | 22 | | (2) be a retiree. |
|---|
| 23 | 23 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 24 | 24 | | an election of a member of the board of trustees of the Employees |
|---|
| 25 | 25 | | Retirement System of Texas that occurs on or after the effective |
|---|
| 26 | 26 | | date of this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2019. |
