66 AN ACT
77 relating to the automatic enrollment of certain women in the
88 Healthy Texas Women program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0997 to read as follows:
1212 Sec. 531.0997. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN
1313 HEALTHY TEXAS WOMEN PROGRAM. (a) In this section, "Healthy Texas
1414 Women program" means a program operated by the commission that is
1515 substantially similar to the demonstration project operated under
1616 former Section 32.0248, Human Resources Code, and that is intended
1717 to expand access to preventive health and family planning services
1818 for women in this state.
1919 (b) Subject to the eligibility requirements of the Healthy
2020 Texas Women program, the commission shall identify and
2121 automatically enroll in the program a woman who is a Medicaid
2222 recipient or enrollee in the child health plan program but who will
2323 lose eligibility for benefits under the applicable program because
2424 of the woman's age. The commission shall implement the automatic
2525 enrollment in a manner that:
2626 (1) ensures a seamless transition in the provision of
2727 services between Medicaid or the child health plan program, as
2828 applicable, and the Healthy Texas Women program; and
2929 (2) allows a woman to begin receiving services through
3030 the Healthy Texas Women program on the first day the woman is no
3131 longer eligible for Medicaid or the child health plan program, as
3232 applicable.
3333 (c) The executive commissioner shall adopt rules necessary
3434 to implement this section.
3535 SECTION 2. This Act takes effect September 1, 2020.
