126 AN ACT
137 relating to the date of the election for trustees of an independent
148 school district.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16- SECTION 1. Section 11.0581, Education Code, is amended by
17- adding subsection (f) to read as follows:
18- (f) An election for trustees of an independent school
19- district that is wholly located in a county with a population of
20- less than 20,000 may be held on a uniform election date even if no
21- other political subdivision with which the district may have held a
22- joint election is conducting an election.

10+ SECTION 1. The heading to Section 11.0581, Education Code,
11+ is amended to read as follows:
12+ Sec. 11.0581. JOINT ELECTION PROCEDURES [ELECTIONS
13+ REQUIRED].
14+ SECTION 2. Sections 11.0581(a), (b), and (d), Education
15+ Code, are amended to read as follows:
16+ (a) This section applies to an [An] election for trustees of
17+ an independent school district [shall be] held on the same date as:
18+ (1) the election for the members of the governing body
19+ of a municipality located in the school district;
20+ (2) the general election for state and county
21+ officers;
22+ (3) the election for the members of the governing body
23+ of a hospital district, if the school district:
24+ (A) is wholly or partly located in a county with a
25+ population of less than 40,000 that is adjacent to a county with a
26+ population of more than three million; and
27+ (B) held its election for trustees jointly with
28+ the election for the members of the governing body of the hospital
29+ district before May 2007; or
30+ (4) the election for the members of the governing
31+ board of a public junior college district in which the school
32+ district is wholly or partly located.
33+ (b) Elections held on the same date as described [provided]
34+ by Subsection (a) shall be held as a joint election under Chapter
35+ 271, Election Code.
36+ (d) The board of trustees of an independent school district
37+ changing an election date to hold a joint election under [to comply
38+ with] this section shall adjust the terms of office of its members
39+ to conform to the new election date.
40+ SECTION 3. This Act takes effect September 1, 2019.
