66 AN ACT
77 relating to an exemption for a homeless individual from the payment
88 of a fee for the issuance of a driver's license or personal
99 identification certificate.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter R, Chapter 521, Transportation Code,
1212 is amended by adding Section 521.4265 to read as follows:
1313 Sec. 521.4265. EXEMPTION FOR HOMELESS INDIVIDUAL. (a) In
1414 this section, "homeless individual":
1515 (1) means an individual who:
1616 (A) lacks a fixed, regular, and adequate
1717 nighttime residence; or
1818 (B) has a primary nighttime residence that is:
1919 (i) a supervised publicly or privately
2020 operated shelter designed to provide temporary living
2121 accommodations, including welfare hotels, congregate shelters, and
2222 transitional housing for the mentally ill;
2323 (ii) an institution that provides a
2424 temporary residence for individuals intended to be
2525 institutionalized; or
2626 (iii) a public or private place not
2727 designed for, or ordinarily used as, a regular sleeping
2828 accommodation for human beings; and
2929 (2) does not include an individual who is imprisoned
3030 or otherwise detained in a correctional facility.
3131 (b) Except as provided by Subsections (f) and (i), a
3232 homeless individual is entitled to an exemption from the payment of
3333 fees under this chapter for the issuance of a driver's license or
3434 personal identification certificate.
3535 (c) For the purposes of this section, a person's status as a
3636 homeless individual must be confirmed by a notarized affidavit
3737 from:
3838 (1) an employee of a homeless shelter or transitional
3939 housing facility;
4040 (2) an employee of an organization that provides to
4141 homeless individuals or assists homeless individuals in obtaining
4242 services such as health services, mental or behavioral health
4343 services, substance abuse services, public assistance services, or
4444 employment services;
4545 (3) an attorney licensed to practice law in this
4646 state;
4747 (4) a peace officer who is an official homeless
4848 liaison;
4949 (5) an employee of a faith-based organization that
5050 provides benefits or services to homeless individuals; or
5151 (6) a counselor or administrator at a school attended
5252 by the homeless individual.
5353 (d) A person may not charge a fee for the affidavit
5454 described by Subsection (c).
5555 (e) An affidavit described by Subsection (c) may not be used
5656 for a driver's license or personal identification certificate
5757 application if the affidavit was signed more than 60 days before the
5858 date the application is submitted.
5959 (f) Subsection (b) does not apply to a person subject to the
6060 registration requirements of Chapter 62, Code of Criminal
6161 Procedure.
6262 (g) For each exemption granted under this section the
6363 department shall deposit to the credit of the Texas mobility fund an
6464 amount from the identification fee exemption account under
6565 Subsection (h) that is equal to the amount of the waived fee that
6666 would otherwise be deposited to the mobility fund.
6767 (h) The identification fee exemption account is created as
6868 an account in the general revenue fund of the state treasury. The
6969 fund consists of grants and donations made to the department for the
7070 purposes of this section. The department shall administer the
7171 account. Money in the account may be appropriated for the purposes
7272 of Subsection (g).
7373 (i) The department may not grant an exemption under this
7474 section if money is not available in the identification fee
7575 exemption account to meet the requirements of Subsection (g).
7676 SECTION 2. This Act takes effect September 1, 2019.
