7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. The heading to Section 37.020, Education Code, |
---|
9 | 15 | | is amended to read as follows: |
---|
10 | 16 | | Sec. 37.020. REPORTS RELATING TO OUT-OF-SCHOOL |
---|
11 | 17 | | SUSPENSIONS, EXPULSIONS, AND DISCIPLINARY ALTERNATIVE EDUCATION |

12 | 18 | | PROGRAM PLACEMENTS. |

13 | 19 | | SECTION 2. Section 37.020, Education Code, is amended by |
---|
14 | 20 | | adding Subsection (f) to read as follows: |

15 | 21 | | (f) For each out-of-school suspension under Section 37.005, |
---|
16 | 22 | | the district shall report: |
---|
17 | 23 | | (1) information identifying the student, including |
---|
18 | 24 | | the student's race, sex, and date of birth, that will enable the |
---|
19 | 25 | | agency to compare placement data with information collected through |
---|
20 | 26 | | other reports; |
---|
21 | 27 | | (2) information indicating the basis for the |
---|
22 | 28 | | suspension; |
---|
23 | 29 | | (3) the number of full or partial days the student was |
---|
24 | 30 | | suspended; and |
---|
25 | 31 | | (4) the number of out-of-school suspensions that were |
---|
26 | 32 | | inconsistent with the guidelines included in the student code of |
---|
27 | 33 | | conduct under Section 37.001(a)(3). |
---|
28 | 34 | | SECTION 3. This Act applies beginning with the 2019-2020 |
---|
29 | 35 | | school year. |
---|
30 | 36 | | SECTION 4. This Act takes effect immediately if it receives |
---|
31 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
32 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
33 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
34 | 40 | | Act takes effect September 1, 2019. |
