411 AN ACT
512 relating to the prosecution of and punishment for the offense of
613 sexual assault; enhancing a criminal penalty.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. This Act shall be known as Melissa's Law.
916 SECTION 2. Sections 22.011(e) and (f), Penal Code, are
1017 amended to read as follows:
1118 (e) It is an affirmative defense to prosecution under
1219 Subsection (a)(2):
1320 (1) that the actor was the spouse of the child at the
1421 time of the offense; or
1522 (2) that:
1623 (A) the actor was not more than three years older
1724 than the victim and at the time of the offense:
1825 (i) was not required under Chapter 62, Code
1926 of Criminal Procedure, to register for life as a sex offender; or
2027 (ii) was not a person who under Chapter 62,
2128 Code of Criminal Procedure, had a reportable conviction or
2229 adjudication for an offense under this section; and
2330 (B) the victim:
2431 (i) was a child of 14 years of age or older;
2532 and
2633 (ii) was not:
2734 (a) a person whom the actor was
2835 prohibited from marrying or purporting to marry or with whom the
2936 actor was prohibited from living under the appearance of being
3037 married under Section 25.01; or
3138 (b) a person with whom the actor was
3239 prohibited from engaging in sexual intercourse or deviate sexual
3340 intercourse under Section 25.02.
3441 (f) An offense under this section is a felony of the second
3542 degree, except that an offense under this section is a felony of the
3643 first degree if the victim was:
3744 (1) a person whom the actor was prohibited from
3845 marrying or purporting to marry or with whom the actor was
3946 prohibited from living under the appearance of being married under
4047 Section 25.01; or
4148 (2) a person with whom the actor was prohibited from
4249 engaging in sexual intercourse or deviate sexual intercourse under
4350 Section 25.02.
4451 SECTION 3. The changes in law made by this Act apply only to
4552 an offense committed on or after the effective date of this Act. An
4653 offense committed before the effective date of this Act is governed
4754 by the law in effect when the offense was committed, and the former
4855 law is continued in effect for that purpose. For purposes of this
4956 section, an offense was committed before the effective date of this
5057 Act if any element of the offense occurred before that date.
5158 SECTION 4. This Act takes effect September 1, 2019.
