66 AN ACT
77 relating to collecting data regarding unaccompanied minors in
88 certain child-care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0412 to read as follows:
1212 Sec. 531.0412. DATA REGARDING UNACCOMPANIED MINORS IN
1313 CERTAIN CHILD-CARE FACILITIES. (a) In this section,
1414 "unaccompanied minor" means a child described by 6 U.S.C. Section
1515 279(g).
1616 (b) The commission shall collect the following statistical
1717 information for each unaccompanied minor in the care of a
1818 residential child-care facility, as defined by Section 42.002,
1919 Human Resources Code, licensed by the Department of Family and
2020 Protective Services:
2121 (1) the child's gender;
2222 (2) the child's age;
2323 (3) the child's country of origin;
2424 (4) whether the child has a disability; and
2525 (5) whether the facility primarily provides care for
2626 children under the age of five.
2727 (c) Identifying information about an unaccompanied minor
2828 collected under this section is confidential and is not subject to
2929 disclosure under Chapter 552.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
