| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.0412 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.0412. DATA REGARDING UNACCOMPANIED MINORS IN |
|---|
| 13 | 13 | | CERTAIN CHILD-CARE FACILITIES. (a) In this section, |
|---|
| 14 | 14 | | "unaccompanied minor" means a child described by 6 U.S.C. Section |
|---|
| 15 | 15 | | 279(g). |
|---|
| 16 | 16 | | (b) The commission shall collect the following statistical |
|---|
| 17 | 17 | | information for each unaccompanied minor in the care of a |
|---|
| 18 | 18 | | residential child-care facility, as defined by Section 42.002, |
|---|
| 19 | 19 | | Human Resources Code, licensed by the Department of Family and |
|---|
| 20 | 20 | | Protective Services: |
|---|
| 21 | 21 | | (1) the child's gender; |
|---|
| 22 | 22 | | (2) the child's age; |
|---|
| 23 | 23 | | (3) the child's country of origin; |
|---|
| 24 | 24 | | (4) whether the child has a disability; and |
|---|
| 25 | 25 | | (5) whether the facility primarily provides care for |
|---|
| 26 | 26 | | children under the age of five. |
|---|
| 27 | 27 | | (c) Identifying information about an unaccompanied minor |
|---|
| 28 | 28 | | collected under this section is confidential and is not subject to |
|---|
| 29 | 29 | | disclosure under Chapter 552. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2019. |
