76 AN ACT
87 relating to health benefit plan coverage for ovarian cancer testing
98 and screening.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 1370.003(b), Insurance Code, is amended
1211 to read as follows:
1312 (b) Coverage required under this section includes at a
1413 minimum:
1514 (1) a CA 125 blood test; [and]
1615 (2) a conventional Pap smear screening or a screening
1716 using liquid-based cytology methods, as approved by the United
1817 States Food and Drug Administration, alone or in combination with a
1918 test approved by the United States Food and Drug Administration for
2019 the detection of the human papillomavirus; and
2120 (3) any other test or screening approved by the United
2221 States Food and Drug Administration for the detection of ovarian
2322 cancer.
2423 SECTION 2. Section 1370.003, Insurance Code, as amended by
2524 this Act, applies only to a health benefit plan delivered, issued
2625 for delivery, or renewed on or after January 1, 2020. A health
2726 benefit plan delivered, issued for delivery, or renewed before
2827 January 1, 2020, is governed by the law as it existed immediately
2928 before the effective date of this Act, and that law is continued in
3029 effect for that purpose.
3130 SECTION 3. This Act takes effect September 1, 2019.
