57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to the entitlement of spouses of certain veterans with
810 disabilities to a veteran's employment preference.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 657.002, Government Code, is amended to
1113 read as follows:
1214 Sec. 657.002. INDIVIDUALS QUALIFIED FOR VETERAN'S
1315 EMPLOYMENT PREFERENCE. The following individuals qualify for a
1416 veteran's employment preference:
1517 (1) a veteran, including a veteran with a disability;
1618 (2) a veteran's surviving spouse who has not
1719 remarried; [and]
1820 (3) an orphan of a veteran if the veteran was killed
1921 while on active duty; and
2022 (4) the spouse of a veteran with a disability if the
2123 veteran:
2224 (A) has a total disability rating based either on
2325 having a service-connected disability with a disability rating of
2426 100 percent or on individual unemployability; and
2527 (B) is receiving Supplemental Security Income
2628 (SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
2729 Security Disability Insurance (SSDI) benefits under 42 U.S.C.
2830 Section 401 et seq.
2931 SECTION 2. Section 657.003(b), Government Code, is amended
3032 to read as follows:
3133 (b) A state agency shall provide to an individual entitled
3234 to a veteran's employment preference for employment or appointment
3335 over other applicants for the same position who do not have a
3436 greater qualification a veteran's employment preference, in the
3537 following order of priority:
3638 (1) a veteran with a disability;
3739 (2) a veteran;
3840 (3) a spouse of a veteran with a disability as
3941 described by Section 657.002(4);
4042 (4) a veteran's surviving spouse who has not
4143 remarried; and
4244 (5) [(4)] an orphan of a veteran if the veteran was
4345 killed while on active duty.
4446 SECTION 3. Section 657.005(b), Government Code, is amended
4547 to read as follows:
4648 (b) An applicant who is either a veteran with a disability
4749 or a spouse of a veteran with a disability as described by Section
4850 657.002(4) shall furnish the official records to the individual
4951 whose duty is to fill the position.
5052 SECTION 4. The changes in law made by this Act apply only to
5153 an open position with a state agency for which the state agency
5254 begins accepting applications on or after the effective date of
5355 this Act. An open position with a state agency for which the state
5456 agency begins accepting applications before the effective date of
5557 this Act is governed by the law in effect on the date the state
5658 agency began accepting applications, and the former law is
5759 continued in effect for that purpose.
5860 SECTION 5. This Act takes effect September 1, 2019.
