66 AN ACT
77 relating to the establishment of a pilot program for the issuance of
88 digital identification.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 7, Transportation Code, is
1111 amended by adding Chapter 526 to read as follows:
1212 CHAPTER 526. DIGITAL IDENTIFICATION PILOT PROGRAM
1313 Sec. 526.001. DEFINITIONS. In this chapter:
1414 (1) "Department" and "driver's license" have the
1515 meanings assigned by Section 521.001.
1616 (2) "Digital identification" includes digital
1717 driver's licenses and digital personal identification
1818 certificates.
1919 Sec. 526.002. DIGITAL IDENTIFICATION PILOT PROGRAM. (a)
2020 The department by rule shall establish a pilot program for the
2121 issuance of digital identification.
2222 (b) In establishing the digital identification pilot
2323 program, the department shall:
2424 (1) assess existing department infrastructure and
2525 identify changes required to implement the program;
2626 (2) upgrade department infrastructure according to
2727 the department's findings under Subdivision (1);
2828 (3) acquire a mobile application that:
2929 (A) displays digital identification that
3030 includes the information described by Section 521.121(a) on a
3131 wireless communication device;
3232 (B) includes an authentication and verification
3333 process for a wireless communication device; and
3434 (C) may be used in any location regardless of the
3535 location's level of wireless connectivity or cellular telephone
3636 service;
3737 (4) deploy the digital identification mobile
3838 application at no cost to focus groups for testing and evaluation;
3939 (5) implement a law enforcement version of the
4040 application for field testing; and
4141 (6) ensure that the privacy rights of pilot program
4242 participants are protected.
4343 (c) Digital identification issued under this section may
4444 not be used or accepted as valid proof of identification.
4545 (d) The department may contract with a third party to
4646 establish the pilot program described by this section if the
4747 contract is at no cost to the department. In contracting with a
4848 third party, the department shall give a preference to vendors
4949 whose principal office is located in the United States.
5050 (e) The department shall prepare a report containing the
5151 results of the pilot program and the department's recommendations.
5252 The department shall submit the report to the Public Safety
5353 Commission and the legislature not later than the 180th day after
5454 the date of completion of the pilot program.
5555 Sec. 526.003. EXPIRATION. This chapter expires September
5656 1, 2021.
5757 SECTION 2. The Department of Public Safety shall adopt the
5858 initial rules for the digital identification pilot program under
5959 Chapter 526, Transportation Code, as added by this Act, not later
6060 than February 1, 2020.
6161 SECTION 3. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2019.
