| 7 | 7 | | relating to the establishment of a pilot program for the issuance of |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle B, Title 7, Transportation Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 526 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 526. DIGITAL IDENTIFICATION PILOT PROGRAM |
|---|
| 13 | 13 | | Sec. 526.001. DEFINITIONS. In this chapter: |
|---|
| 14 | 14 | | (1) "Department" and "driver's license" have the |
|---|
| 15 | 15 | | meanings assigned by Section 521.001. |
|---|
| 16 | 16 | | (2) "Digital identification" includes digital |
|---|
| 17 | 17 | | driver's licenses and digital personal identification |
|---|
| 18 | 18 | | certificates. |
|---|
| 19 | 19 | | Sec. 526.002. DIGITAL IDENTIFICATION PILOT PROGRAM. (a) |
|---|
| 20 | 20 | | The department by rule shall establish a pilot program for the |
|---|
| 21 | 21 | | issuance of digital identification. |
|---|
| 22 | 22 | | (b) In establishing the digital identification pilot |
|---|
| 23 | 23 | | program, the department shall: |
|---|
| 24 | 24 | | (1) assess existing department infrastructure and |
|---|
| 25 | 25 | | identify changes required to implement the program; |
|---|
| 26 | 26 | | (2) upgrade department infrastructure according to |
|---|
| 27 | 27 | | the department's findings under Subdivision (1); |
|---|
| 28 | 28 | | (3) acquire a mobile application that: |
|---|
| 29 | 29 | | (A) displays digital identification that |
|---|
| 30 | 30 | | includes the information described by Section 521.121(a) on a |
|---|
| 31 | 31 | | wireless communication device; |
|---|
| 32 | 32 | | (B) includes an authentication and verification |
|---|
| 33 | 33 | | process for a wireless communication device; and |
|---|
| 34 | 34 | | (C) may be used in any location regardless of the |
|---|
| 35 | 35 | | location's level of wireless connectivity or cellular telephone |
|---|
| 36 | 36 | | service; |
|---|
| 37 | 37 | | (4) deploy the digital identification mobile |
|---|
| 38 | 38 | | application at no cost to focus groups for testing and evaluation; |
|---|
| 39 | 39 | | (5) implement a law enforcement version of the |
|---|
| 40 | 40 | | application for field testing; and |
|---|
| 41 | 41 | | (6) ensure that the privacy rights of pilot program |
|---|
| 42 | 42 | | participants are protected. |
|---|
| 43 | 43 | | (c) Digital identification issued under this section may |
|---|
| 44 | 44 | | not be used or accepted as valid proof of identification. |
|---|
| 45 | 45 | | (d) The department may contract with a third party to |
|---|
| 46 | 46 | | establish the pilot program described by this section if the |
|---|
| 47 | 47 | | contract is at no cost to the department. In contracting with a |
|---|
| 48 | 48 | | third party, the department shall give a preference to vendors |
|---|
| 49 | 49 | | whose principal office is located in the United States. |
|---|
| 50 | 50 | | (e) The department shall prepare a report containing the |
|---|
| 51 | 51 | | results of the pilot program and the department's recommendations. |
|---|
| 52 | 52 | | The department shall submit the report to the Public Safety |
|---|
| 53 | 53 | | Commission and the legislature not later than the 180th day after |
|---|
| 54 | 54 | | the date of completion of the pilot program. |
|---|
| 55 | 55 | | Sec. 526.003. EXPIRATION. This chapter expires September |
|---|
| 56 | 56 | | 1, 2021. |
|---|
| 57 | 57 | | SECTION 2. The Department of Public Safety shall adopt the |
|---|
| 58 | 58 | | initial rules for the digital identification pilot program under |
|---|
| 59 | 59 | | Chapter 526, Transportation Code, as added by this Act, not later |
|---|
| 60 | 60 | | than February 1, 2020. |
|---|
| 61 | 61 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 62 | 62 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 63 | 63 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 64 | 64 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 65 | 65 | | Act takes effect September 1, 2019. |
