10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 51.305(b), Government Code, as effective |
---|
12 | 12 | | September 1, 2019, is amended to read as follows: |
---|
13 | 13 | | (b) The commissioners court of a county may adopt a district |
---|
14 | 14 | | court records archive fee of not more than $10 [$5] for the filing |
---|
15 | 15 | | of a suit, including an appeal from an inferior court, or a |
---|
16 | 16 | | cross-action, counterclaim, intervention, contempt action, motion |
---|
17 | 17 | | for new trial, or third-party petition, in any court in the county |
---|
18 | 18 | | for which the district clerk accepts filings as part of the county's |
---|
19 | 19 | | annual budget. The fee must be set and itemized in the county's |
---|
20 | 20 | | budget as part of the budget preparation process and must be |
---|
21 | 21 | | approved in a public meeting. The fee is for preservation and |
---|
22 | 22 | | restoration services performed in connection with maintaining a |
---|
23 | 23 | | district court records archive. |
---|
24 | 24 | | SECTION 2. Section 51.317(b), Government Code, as effective |
---|
25 | 25 | | September 1, 2019, is amended to read as follows: |

26 | 26 | | (b) The fees are: |
---|
27 | 27 | | (1) except as provided by Subsection (b-1), for filing |
---|
28 | 28 | | a suit, including an appeal from an inferior court, $50; |
---|
29 | 29 | | (2) for filing a cross-action, counterclaim, |
