9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to a landowner's liability for injuries incurred during
612 certain recreational activities.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 75.001(3), Civil Practice and Remedies
915 Code, is amended to read as follows:
1016 (3) "Recreation" means an activity such as:
1117 (A) hunting;
1218 (B) fishing;
1319 (C) swimming;
1420 (D) boating;
1521 (E) camping;
1622 (F) picnicking;
1723 (G) hiking;
1824 (H) pleasure driving, including off-road
1925 motorcycling and off-road automobile driving and the use of
2026 all-terrain vehicles and recreational off-highway vehicles;
2127 (I) nature study, including bird-watching;
2228 (J) cave exploration;
2329 (K) waterskiing and other water sports;
2430 (L) any other activity associated with enjoying
2531 nature or the outdoors;
2632 (M) bicycling and mountain biking;
2733 (N) disc golf;
2834 (O) on-leash and off-leash walking of dogs; [or]
2935 (P) radio control flying and related activities;
3036 or
3137 (Q) rock climbing.
3238 SECTION 2. The change in law made by this Act applies only
3339 to a cause of action that accrues on or after the effective date of
3440 this Act. A cause of action that accrued before the effective date
3541 of this Act is governed by the law applicable to the cause of action
3642 immediately before the effective date of this Act, and that law is
3743 continued in effect for that purpose.
3844 SECTION 3. This Act takes effect immediately if it receives
3945 a vote of two-thirds of all the members elected to each house, as
4046 provided by Section 39, Article III, Texas Constitution. If this
4147 Act does not receive the vote necessary for immediate effect, this
4248 Act takes effect September 1, 2019.
