5 | 11 | | relating to a landowner's liability for injuries incurred during |

6 | 12 | | certain recreational activities. |

7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 75.001(3), Civil Practice and Remedies |
---|
9 | 15 | | Code, is amended to read as follows: |
---|
10 | 16 | | (3) "Recreation" means an activity such as: |
---|
11 | 17 | | (A) hunting; |
---|
12 | 18 | | (B) fishing; |
---|
13 | 19 | | (C) swimming; |
---|
14 | 20 | | (D) boating; |
---|
15 | 21 | | (E) camping; |
---|
16 | 22 | | (F) picnicking; |
---|
17 | 23 | | (G) hiking; |
---|
18 | 24 | | (H) pleasure driving, including off-road |
---|
19 | 25 | | motorcycling and off-road automobile driving and the use of |
---|
20 | 26 | | all-terrain vehicles and recreational off-highway vehicles; |
---|
21 | 27 | | (I) nature study, including bird-watching; |
---|
22 | 28 | | (J) cave exploration; |
---|
23 | 29 | | (K) waterskiing and other water sports; |
---|
24 | 30 | | (L) any other activity associated with enjoying |
---|
25 | 31 | | nature or the outdoors; |
---|
26 | 32 | | (M) bicycling and mountain biking; |
---|
27 | 33 | | (N) disc golf; |
---|
28 | 34 | | (O) on-leash and off-leash walking of dogs; [or] |
---|
29 | 35 | | (P) radio control flying and related activities; |
---|
30 | 36 | | or |
---|
31 | 37 | | (Q) rock climbing. |

32 | 38 | | SECTION 2. The change in law made by this Act applies only |
---|
33 | 39 | | to a cause of action that accrues on or after the effective date of |
---|
34 | 40 | | this Act. A cause of action that accrued before the effective date |
---|
35 | 41 | | of this Act is governed by the law applicable to the cause of action |
---|
36 | 42 | | immediately before the effective date of this Act, and that law is |
---|
37 | 43 | | continued in effect for that purpose. |
---|
38 | 44 | | SECTION 3. This Act takes effect immediately if it receives |
---|
39 | 45 | | a vote of two-thirds of all the members elected to each house, as |
---|
40 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
41 | 47 | | Act does not receive the vote necessary for immediate effect, this |
---|
42 | 48 | | Act takes effect September 1, 2019. |
