| 7 | 7 | | relating to the eligibility of certain criminal defendants for an |

| 8 | 8 | | order of nondisclosure of criminal history record information. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 411.072(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) This section applies only to a person who[: |
|---|
| 13 | 13 | | [(1)] was placed on deferred adjudication community |
|---|
| 14 | 14 | | supervision under Subchapter C, Chapter 42A, Code of Criminal |
|---|
| 15 | 15 | | Procedure, for a misdemeanor other than a misdemeanor: |
|---|
| 16 | 16 | | (1) [(A)] under Chapter 20, 21, 22, 25, 42, 43, 46, or |
|---|
| 17 | 17 | | 71, Penal Code; or |
|---|
| 18 | 18 | | (2) [(B)] with respect to which an affirmative finding |
|---|
| 19 | 19 | | under Article 42A.105(f), Code of Criminal Procedure, or former |
|---|
| 20 | 20 | | Section 5(k), Article 42.12, Code of Criminal Procedure, was filed |
|---|
| 21 | 21 | | in the papers of the case[; and |
|---|
| 22 | 22 | | [(2) has never been previously convicted of or placed |
|---|
| 23 | 23 | | on deferred adjudication community supervision for another offense |
|---|
| 24 | 24 | | other than a traffic offense that is punishable by fine only]. |
|---|
| 25 | 25 | | SECTION 2. Section 411.073(b), Government Code, is amended |
|---|
| 26 | 26 | | to read as follows: |
|---|
| 27 | 27 | | (b) Notwithstanding any other provision of this subchapter |
|---|
| 28 | 28 | | or Subchapter F, a person described by Subsection (a) whose |
|---|
| 29 | 29 | | community supervision is not revoked and who completes the period |
|---|
| 30 | 30 | | of community supervision, including any term of confinement imposed |
|---|
| 31 | 31 | | and payment of all fines, costs, and restitution imposed, may |
|---|
| 32 | 32 | | petition the court that placed the person on community supervision |
|---|
| 33 | 33 | | for an order of nondisclosure of criminal history record |
|---|
| 34 | 34 | | information under this section if the person[: |
|---|
| 35 | 35 | | [(1)] satisfies the requirements of this section and |
|---|
| 36 | 36 | | Section 411.074[; and |
|---|
| 37 | 37 | | [(2) has never been previously convicted of or placed |
|---|
| 38 | 38 | | on deferred adjudication community supervision for another offense |
|---|
| 39 | 39 | | other than a traffic offense that is punishable by fine only]. |
|---|
| 40 | 40 | | SECTION 3. Section 411.0731(b), Government Code, is amended |
|---|
| 41 | 41 | | to read as follows: |
|---|
| 42 | 42 | | (b) Notwithstanding any other provision of this subchapter |
|---|
| 43 | 43 | | or Subchapter F, a person described by Subsection (a) whose |
|---|
| 44 | 44 | | community supervision is not revoked and who completes the period |

| 55 | 55 | | SECTION 4. Section 411.0735(b), Government Code, is amended |
|---|
| 56 | 56 | | to read as follows: |
|---|
| 57 | 57 | | (b) Notwithstanding any other provision of this subchapter |
|---|
| 58 | 58 | | or Subchapter F, a person described by Subsection (a) who completes |
|---|
| 59 | 59 | | the person's sentence, including any term of confinement imposed |
|---|
| 60 | 60 | | and payment of all fines, costs, and restitution imposed, may |
|---|
| 61 | 61 | | petition the court that imposed the sentence for an order of |
|---|
| 62 | 62 | | nondisclosure of criminal history record information under this |
|---|
| 63 | 63 | | section if the person[: |
|---|
| 64 | 64 | | [(1)] satisfies the requirements of this section and |
|---|
| 65 | 65 | | Section 411.074[; and |
|---|
| 66 | 66 | | [(2) has never been previously convicted of or placed |
|---|
| 67 | 67 | | on deferred adjudication community supervision for another offense |
|---|
| 68 | 68 | | other than a traffic offense that is punishable by fine only]. |
|---|
| 69 | 69 | | SECTION 5. Section 411.0736(b), Government Code, is amended |
|---|
| 70 | 70 | | to read as follows: |
|---|
| 71 | 71 | | (b) Notwithstanding any other provision of this subchapter |
|---|
| 72 | 72 | | or Subchapter F, a person described by Subsection (a) who completes |
|---|
| 73 | 73 | | the person's sentence, including any term of confinement imposed |
|---|
| 74 | 74 | | and payment of all fines, costs, and restitution imposed, may |
|---|
| 75 | 75 | | petition the court that imposed the sentence for an order of |
|---|
| 76 | 76 | | nondisclosure of criminal history record information under this |
|---|
| 77 | 77 | | section if the person[: |
|---|
| 78 | 78 | | [(1)] satisfies the requirements of this section and |
|---|
| 79 | 79 | | Section 411.074[; and |
|---|
| 80 | 80 | | [(2) has never been previously convicted of or placed |
|---|
| 81 | 81 | | on deferred adjudication community supervision for another offense |
|---|
| 82 | 82 | | other than a traffic offense that is punishable by fine only]. |
|---|
| 83 | 83 | | SECTION 6. This Act takes effect September 1, 2019. |
