55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of certain criminal defendants for an
88 order of nondisclosure of criminal history record information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.072(a), Government Code, is amended
1111 to read as follows:
1212 (a) This section applies only to a person who[:
1313 [(1)] was placed on deferred adjudication community
1414 supervision under Subchapter C, Chapter 42A, Code of Criminal
1515 Procedure, for a misdemeanor other than a misdemeanor:
1616 (1) [(A)] under Chapter 20, 21, 22, 25, 42, 43, 46, or
1717 71, Penal Code; or
1818 (2) [(B)] with respect to which an affirmative finding
1919 under Article 42A.105(f), Code of Criminal Procedure, or former
2020 Section 5(k), Article 42.12, Code of Criminal Procedure, was filed
2121 in the papers of the case[; and
2222 [(2) has never been previously convicted of or placed
2323 on deferred adjudication community supervision for another offense
2424 other than a traffic offense that is punishable by fine only].
2525 SECTION 2. Section 411.073(b), Government Code, is amended
2626 to read as follows:
2727 (b) Notwithstanding any other provision of this subchapter
2828 or Subchapter F, a person described by Subsection (a) whose
2929 community supervision is not revoked and who completes the period
3030 of community supervision, including any term of confinement imposed
3131 and payment of all fines, costs, and restitution imposed, may
3232 petition the court that placed the person on community supervision
3333 for an order of nondisclosure of criminal history record
3434 information under this section if the person[:
3535 [(1)] satisfies the requirements of this section and
3636 Section 411.074[; and
3737 [(2) has never been previously convicted of or placed
3838 on deferred adjudication community supervision for another offense
3939 other than a traffic offense that is punishable by fine only].
4040 SECTION 3. Section 411.0731(b), Government Code, is amended
4141 to read as follows:
4242 (b) Notwithstanding any other provision of this subchapter
4343 or Subchapter F, a person described by Subsection (a) whose
4444 community supervision is not revoked and who completes the period
4545 of community supervision, including any term of confinement imposed
4646 and payment of all fines, costs, and restitution imposed, may
4747 petition the court that placed the person on community supervision
4848 for an order of nondisclosure of criminal history record
4949 information under this section if the person[:
5050 [(1)] satisfies the requirements of this section and
5151 Section 411.074[; and
5252 [(2) has never been previously convicted of or placed
5353 on deferred adjudication community supervision for another offense
5454 other than a traffic offense that is punishable by fine only].
5555 SECTION 4. Section 411.0735(b), Government Code, is amended
5656 to read as follows:
5757 (b) Notwithstanding any other provision of this subchapter
5858 or Subchapter F, a person described by Subsection (a) who completes
5959 the person's sentence, including any term of confinement imposed
6060 and payment of all fines, costs, and restitution imposed, may
6161 petition the court that imposed the sentence for an order of
6262 nondisclosure of criminal history record information under this
6363 section if the person[:
6464 [(1)] satisfies the requirements of this section and
6565 Section 411.074[; and
6666 [(2) has never been previously convicted of or placed
6767 on deferred adjudication community supervision for another offense
6868 other than a traffic offense that is punishable by fine only].
6969 SECTION 5. Section 411.0736(b), Government Code, is amended
7070 to read as follows:
7171 (b) Notwithstanding any other provision of this subchapter
7272 or Subchapter F, a person described by Subsection (a) who completes
7373 the person's sentence, including any term of confinement imposed
7474 and payment of all fines, costs, and restitution imposed, may
7575 petition the court that imposed the sentence for an order of
7676 nondisclosure of criminal history record information under this
7777 section if the person[:
7878 [(1)] satisfies the requirements of this section and
7979 Section 411.074[; and
8080 [(2) has never been previously convicted of or placed
8181 on deferred adjudication community supervision for another offense
8282 other than a traffic offense that is punishable by fine only].
8383 SECTION 6. This Act takes effect September 1, 2019.
