9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to disaster preparation for state agencies and political
612 subdivisions.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter B, Chapter 418, Government Code, is
915 amended by adding Section 418.0155 to read as follows:
1016 Sec. 418.0155. SUSPENSION LIST. (a) The governor's
1117 office, using existing resources, shall compile and maintain a
1218 comprehensive list of regulatory statutes and rules that may
1319 require suspension during a disaster.
1420 (b) On request by the governor's office, a state agency that
1521 would be impacted by the suspension of a statute or rule on the list
1622 compiled under Subsection (a) shall review the list for accuracy
1723 and shall advise the governor's office regarding any statutes or
1824 rules that should be added to the list.
1925 SECTION 2. Subchapter C, Chapter 418, Government Code, is
2026 amended by adding Section 418.054 to read as follows:
2127 Sec. 418.054. DISASTER PREPARATION CONTRACTS. (a) The
2228 division, in consultation with other state agencies the division
2329 considers appropriate, shall develop a plan to assist political
2430 subdivisions of this state with executing contracts for services
2531 that political subdivisions are likely to need following a
2632 disaster. The plan must include:
2733 (1) training on the benefits to a political
2834 subdivision from executing disaster preparation contracts in
2935 advance of a disaster;
3036 (2) recommendations on the services political
3137 subdivisions are likely to need following a disaster, including
3238 debris management and infrastructure repair; and
3339 (3) assistance to political subdivisions with finding
3440 persons capable of providing the services described by Subdivision
3541 (2) and executing contracts with those persons in advance of a
3642 disaster.
3743 (b) The division shall consult with the comptroller
3844 regarding including a contract for services a political subdivision
3945 is likely to need following a disaster, including debris management
4046 and infrastructure repair, on the schedule of multiple award
4147 contracts developed under Subchapter I, Chapter 2155, or as part of
4248 another cooperative purchasing program administered by the
4349 comptroller.
4450 SECTION 3. This Act takes effect September 1, 2019.
