8 | 8 | | located on property used by a state agency. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 2203, Government Code, is amended by |
---|
11 | 11 | | adding Section 2203.006 to read as follows: |
---|
12 | 12 | | Sec. 2203.006. STANDARDS FOR VENDING MACHINE FOOD AND |
---|
13 | 13 | | BEVERAGES. (a) In this section, "executive commissioner" means the |
---|
14 | 14 | | executive commissioner of the Health and Human Services Commission. |
---|
15 | 15 | | (b) This section applies to food and beverages offered in a |
---|
16 | 16 | | vending machine that is located on property that is: |
---|
17 | 17 | | (1) owned by the state and under the charge and control |
---|
18 | 18 | | of a state agency; or |
---|
19 | 19 | | (2) leased by the state for the use of a state agency. |
---|
20 | 20 | | (c) Food and beverages to which this section applies must |
---|
21 | 21 | | meet minimum nutrition standards adopted by rule by the executive |
---|
22 | 22 | | commissioner. |
---|
23 | 23 | | (d) The minimum nutrition standards must ensure that: |
---|
24 | 24 | | (1) food offered in a vending machine: |
---|
25 | 25 | | (A) contains zero grams of trans fatty acids per |
---|
26 | 26 | | serving, as defined by the United States Food and Drug |
---|
27 | 27 | | Administration; and |
---|
28 | 28 | | (B) contains not more than: |
---|
29 | 29 | | (i) 230 milligrams of sodium per serving if |
---|
30 | 30 | | the food is not a refrigerated meal or other individual meal item; |
---|
31 | 31 | | or |
---|
32 | 32 | | (ii) 480 milligrams of sodium per serving |
---|
33 | 33 | | if the food is a refrigerated meal or other individual meal item; |
---|
34 | 34 | | (2) at least half of the beverage choices offered in a |
---|
35 | 35 | | vending machine, excluding unsweetened milk and 100 percent juice, |
---|
36 | 36 | | contain less than 40 calories per serving; |
---|
37 | 37 | | (3) any milk offered is two percent, one percent, or |
---|
38 | 38 | | nonfat; |
---|
39 | 39 | | (4) if juice is offered, at least one offering is 100 |
---|
40 | 40 | | percent juice with no added sweetener; and |
---|
41 | 41 | | (5) any vegetable juice offered contains not more than |
---|
42 | 42 | | 230 milligrams of sodium per serving. |
---|
43 | 43 | | (e) In addition to the minimum nutrition standards required |
---|
44 | 44 | | under Subsection (d)(1), at least 25 percent of packaged foods that |
---|
45 | 45 | | are offered in a vending machine, other than nuts and seeds that do |
---|
46 | 46 | | not have added fats, oils, or sweeteners, must: |
---|
47 | 47 | | (1) have a calorie content made up of: |
---|
48 | 48 | | (A) not more than 10 percent saturated fat; and |
---|
49 | 49 | | (B) not more than 35 percent sugars, excluding |
---|
50 | 50 | | fruits and vegetables without added sweeteners; and |
---|
51 | 51 | | (2) have less than 200 calories. |
---|
52 | 52 | | (f) A vending machine to which this section applies must |
---|
53 | 53 | | display the total calorie content for each item offered. |
---|
54 | 54 | | (g) The executive commissioner shall, at least every five |
---|
55 | 55 | | years, review and, if necessary, update the minimum nutrition |
---|
56 | 56 | | standards adopted under this section. In reviewing the standards, |
---|
57 | 57 | | the executive commissioner shall consider advancements in |
---|
58 | 58 | | nutrition science, dietary data, new product availability, and |
---|
59 | 59 | | updates to the Dietary Guidelines for Americans, as published by |
---|
60 | 60 | | the United States Department of Agriculture and the United States |
---|
61 | 61 | | Department of Health and Human Services. |
---|
62 | 62 | | (h) A contract with a vendor for operation of a vending |
---|
63 | 63 | | machine to which this section applies must include a provision |
---|
64 | 64 | | requiring the vendor to offer food and beverages that meet the |
---|
65 | 65 | | minimum nutrition standards adopted by the executive commissioner |
---|
66 | 66 | | under this section. |
---|
67 | 67 | | (i) The statewide wellness coordinator designated under |
---|
68 | 68 | | Section 664.053 shall provide information and resources to state |
---|
69 | 69 | | agencies to promote state employee wellness through implementing |
---|
70 | 70 | | the requirements of this section. |
---|
71 | 71 | | SECTION 2. (a) Not later than September 1, 2020, the |
---|
72 | 72 | | executive commissioner of the Health and Human Services Commission |
---|
73 | 73 | | shall adopt rules to establish minimum nutrition standards under |
---|
74 | 74 | | Section 2203.006, Government Code, as added by this Act. |
---|
75 | 75 | | (b) Except as provided by Subsection (c) of this section, a |
---|
76 | 76 | | state agency is not required to comply with Section 2203.006, |
---|
77 | 77 | | Government Code, as added by this Act, until September 1, 2021. |
---|
78 | 78 | | (c) Section 2203.006(h), Government Code, as added by this |
---|
79 | 79 | | Act, applies only to a contract for vending machine services for |
---|
80 | 80 | | which a state agency first advertises or otherwise solicits bids, |
---|
81 | 81 | | proposals, offers, or qualifications on or after September 1, 2020. |
---|
82 | 82 | | SECTION 3. This Act takes effect immediately if it receives |
---|
83 | 83 | | a vote of two-thirds of all the members elected to each house, as |
---|
84 | 84 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
85 | 85 | | Act does not receive the vote necessary for immediate effect, this |
---|
86 | 86 | | Act takes effect September 1, 2019. |
