66 AN ACT
77 relating to medical education coursework and training for
88 physicians in cultural competence and implicit bias.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 51, Education Code, is
1111 amended by adding Section 51.310 to read as follows:
1212 Sec. 51.310. CULTURAL COMPETENCE AND IMPLICIT BIAS MEDICAL
1313 EDUCATION COURSEWORK. (a) In this section:
1414 (1) "Coordinating board" means the Texas Higher
1515 Education Coordinating Board.
1616 (2) "Cultural competence" and "implicit bias" have the
1717 meanings assigned by Section 153.017, Occupations Code.
1818 (3) "Medical school" has the meaning assigned by
1919 Section 61.501.
2020 (b) The coordinating board by rule shall require a medical
2121 school to offer coursework in cultural competence and implicit bias
2222 approved by the Texas Medical Board under Section 153.017(b),
2323 Occupations Code.
2424 (c) A medical school may not award a student a doctor of
2525 medicine (M.D.) or doctor of osteopathic medicine (D.O.) degree
2626 unless the student has successfully completed the number of hours
2727 of coursework in cultural competence and implicit bias required by
2828 coordinating board rule.
2929 SECTION 2. Subchapter A, Chapter 153, Occupations Code, is
3030 amended by adding Section 153.017 to read as follows:
3131 Sec. 153.017. COURSEWORK AND TRAINING IN CULTURAL
3232 COMPETENCE AND IMPLICIT BIAS. (a) In this section:
3333 (1) "Cultural competence" means, with respect to
3434 health care, the ability to address the health issues of
3535 individuals from diverse backgrounds effectively by applying
3636 knowledge, empathy, and insight into the views on health that those
3737 backgrounds present.
3838 (2) "Implicit bias" means:
3939 (A) bias in judgment or behavior that results
4040 from subtle cognitive processes, including implicit attitudes and
4141 stereotypes, that often operate at a level below conscious
4242 awareness and without intentional control; or
4343 (B) implicit attitudes and stereotypes that
4444 result in beliefs or simple associations that a person makes
4545 between an object and its evaluation that are automatically
4646 activated by the mere presence, actual or symbolic, of the attitude
4747 object.
4848 (b) The board shall approve coursework and training in
4949 cultural competence and implicit bias for purposes of Section
5050 156.0011 of this code and Section 51.310(c), Education Code.
5151 (c) Coursework and training approved under Subsection (b)
5252 must be:
5353 (1) designed to address medical decisions and
5454 treatment relating to a person's race, ethnicity, nationality,
5555 language, sex, gender, physical and mental ability, and
5656 socioeconomic status; and
5757 (2) developed in consultation with:
5858 (A) the Texas Higher Education Coordinating
5959 Board; and
6060 (B) the Association of American Medical Colleges
6161 or another nationally recognized organization that reviews medical
6262 school curricula.
6363 SECTION 3. Subchapter A, Chapter 156, Occupations Code, is
6464 amended by adding Section 156.0011 to read as follows:
6565 Sec. 156.0011. REQUIRED COURSEWORK OR TRAINING IN CULTURAL
6666 COMPETENCE AND IMPLICIT BIAS; WAIVER. (a) In this section,
6767 "cultural competence" and "implicit bias" have the meanings
6868 assigned by Section 153.017.
6969 (b) Except as provided by Subsection (d), the board may not
7070 issue a registration permit to or renew the registration permit of a
7171 person unless the person has successfully completed:
7272 (1) coursework in cultural competence and implicit
7373 bias as a student in a doctor of medicine or doctor of osteopathic
7474 medicine degree program as required by Section 51.310, Education
7575 Code; or
7676 (2) training in cultural competence and implicit bias
7777 approved by the board under Section 153.017(b).
7878 (c) A person who satisfies the requirements of Subsection
7979 (b) is not required to complete additional coursework or training
8080 described by that subsection for the subsequent renewal of the
8181 person's registration permit.
8282 (d) The board by rule shall establish the minimum number of
8383 hours of training necessary to satisfy Subsection (b)(2). A
8484 license holder may complete the training as part of the hours of
8585 continuing medical education completed to comply with Section
8686 156.051(a)(2).
8787 (e) The board may waive the requirements of this section for
8888 a person who demonstrates in a manner prescribed by the board that
8989 the person has successfully completed coursework or training that
9090 is substantially equivalent to that approved by the board under
9191 Section 153.017(b).
9292 SECTION 4. Not later than December 1, 2019, the Texas Higher
9393 Education Coordinating Board and the Texas Medical Board shall
9494 adopt the rules necessary to implement this Act.
9595 SECTION 5. (a) Section 51.310(c), Education Code, as added
9696 by this Act, applies only to a student who enrolls in a doctor of
9797 medicine (M.D.) or doctor of osteopathic medicine (D.O.) degree
9898 program on or after January 1, 2020.
9999 (b) Section 156.0011(b), Occupations Code, as added by this
100100 Act, applies only to a registration permit issued or renewed on or
101101 after January 1, 2020.
102102 SECTION 6. This Act takes effect September 1, 2019.
