| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 125.0017, Civil Practice and Remedies |
|---|
| 11 | 11 | | Code, as added by Chapter 1135 (H.B. 240), Acts of the 85th |
|---|
| 12 | 12 | | Legislature, Regular Session, 2017, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 125.0017. NOTICE OF ARREST FOR CERTAIN ACTIVITIES. If |
|---|
| 14 | 14 | | a law enforcement agency makes an arrest related to an activity |
|---|
| 15 | 15 | | described by Section 125.0015(a)(6), (7), or (18) that occurs at |
|---|
| 16 | 16 | | property leased to a person operating a massage establishment as |
|---|
| 17 | 17 | | defined by Section 455.001, Occupations Code, not later than the |
|---|
| 18 | 18 | | 14th day after the date of the arrest, the law enforcement agency |
|---|
| 19 | 19 | | may provide written notice by certified mail to [each person |
|---|
| 20 | 20 | | maintaining] the property owner of the arrest. |

| 21 | 21 | | SECTION 2. Section 125.0017, Civil Practice and Remedies |
|---|
| 22 | 22 | | Code, as added by Chapter 858 (H.B. 2552), Acts of the 85th |
|---|
| 23 | 23 | | Legislature, Regular Session, 2017, is repealed. |
|---|
| 24 | 24 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to an arrest that occurs on or after the effective date of this Act. |
|---|
| 26 | 26 | | An arrest that occurred before the effective date of this Act is |
|---|
| 27 | 27 | | governed by the law as it existed immediately before the effective |
|---|
| 28 | 28 | | date of this Act, and that law is continued in effect for that |
|---|
| 29 | 29 | | purpose. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2019. |
