66 AN ACT
77 relating to notice of arrest for certain activities occurring at
88 property leased to a person operating a massage establishment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 125.0017, Civil Practice and Remedies
1111 Code, as added by Chapter 1135 (H.B. 240), Acts of the 85th
1212 Legislature, Regular Session, 2017, is amended to read as follows:
1313 Sec. 125.0017. NOTICE OF ARREST FOR CERTAIN ACTIVITIES. If
1414 a law enforcement agency makes an arrest related to an activity
1515 described by Section 125.0015(a)(6), (7), or (18) that occurs at
1616 property leased to a person operating a massage establishment as
1717 defined by Section 455.001, Occupations Code, not later than the
1818 14th day after the date of the arrest, the law enforcement agency
1919 may provide written notice by certified mail to [each person
2020 maintaining] the property owner of the arrest.
2121 SECTION 2. Section 125.0017, Civil Practice and Remedies
2222 Code, as added by Chapter 858 (H.B. 2552), Acts of the 85th
2323 Legislature, Regular Session, 2017, is repealed.
2424 SECTION 3. The change in law made by this Act applies only
2525 to an arrest that occurs on or after the effective date of this Act.
2626 An arrest that occurred before the effective date of this Act is
2727 governed by the law as it existed immediately before the effective
2828 date of this Act, and that law is continued in effect for that
2929 purpose.
3030 SECTION 4. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
