8 | 8 | | Crime Information Center. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 17, Code of Criminal Procedure, is |
---|
11 | 11 | | amended by adding Article 17.50 to read as follows: |
---|
12 | 12 | | Art. 17.50. ENTRY OF BOND CONDITIONS INTO TEXAS CRIME |
---|
13 | 13 | | INFORMATION CENTER; DUTIES OF MAGISTRATES, SHERIFFS, AND |
---|
14 | 14 | | DEPARTMENT OF PUBLIC SAFETY. (a) In this article, "database" means |
---|
15 | 15 | | the statewide law enforcement information system maintained by the |
---|
16 | 16 | | Department of Public Safety, also known as the Texas Crime |
---|
17 | 17 | | Information Center. |
---|
18 | 18 | | (b) As soon as possible but not later than the next business |
---|
19 | 19 | | day after the date a magistrate imposes a condition of bond on an |
---|
20 | 20 | | arrested person under this chapter, the magistrate shall notify the |
---|
21 | 21 | | sheriff of the condition and provide to the sheriff the following |
---|
22 | 22 | | information: |
---|
23 | 23 | | (1) the name, sex, race, date of birth, personal |
---|
24 | 24 | | descriptors, address, and county of residence of the person on whom |
---|
25 | 25 | | the condition of bond is imposed; |
---|
26 | 26 | | (2) any known identifying number of the person on whom |
---|
27 | 27 | | the condition of bond is imposed, including the person's social |
---|
28 | 28 | | security number or driver's license number; |
---|
29 | 29 | | (3) the name and county of residence of any named |
---|
30 | 30 | | person the condition of bond is intended to protect, and if |
---|
31 | 31 | | different and applicable, the name and county of residence of the |
---|
32 | 32 | | victim of the alleged offense; and |
---|
33 | 33 | | (4) the condition of bond imposed. |
---|
34 | 34 | | (c) On receipt of the information described by Subsection |
---|
35 | 35 | | (b), the sheriff shall enter the information into the database. |
---|
36 | 36 | | (d) As soon as possible but not later than the next business |
---|
37 | 37 | | day after the date a magistrate revokes a bond that contains a |
---|
38 | 38 | | condition, modifies the terms of or removes a condition of bond, or |
---|
39 | 39 | | disposes of the underlying criminal charges in the case, the |
---|
40 | 40 | | magistrate shall notify the sheriff and provide the sheriff with |
---|
41 | 41 | | information that is sufficient to enable the sheriff to update the |
---|
42 | 42 | | database accordingly. |
---|
43 | 43 | | (e) The Department of Public Safety shall modify the |
---|
44 | 44 | | database to enable the database to accept and maintain detailed |
---|
45 | 45 | | information regarding the requirements and status of a condition of |
---|
46 | 46 | | bond imposed by a magistrate, including information described by |
---|
47 | 47 | | Subsections (b) and (d). |
---|
48 | 48 | | (f) This article does not apply to a condition of bond |
---|
49 | 49 | | imposed under Article 17.441. |
---|
50 | 50 | | SECTION 2. Not later than January 1, 2020, the Department of |
---|
51 | 51 | | Public Safety of the State of Texas shall modify the statewide law |
---|
52 | 52 | | enforcement information system maintained by the department, also |
---|
53 | 53 | | known as the Texas Crime Information Center, to enable the database |
---|
54 | 54 | | to accept and maintain detailed information regarding the |
---|
55 | 55 | | requirements and status of a condition of bond imposed by a |
---|
56 | 56 | | magistrate, as required by Article 17.50(e), Code of Criminal |
---|
57 | 57 | | Procedure, as added by this Act. |
---|
58 | 58 | | SECTION 3. (a) Except as provided by Subsection (b) of this |
---|
59 | 59 | | section, this Act takes effect January 1, 2020. |
---|
60 | 60 | | (b) Section 2 of this Act takes effect September 1, 2019. |
---|
