66 AN ACT
77 relating to the entry of certain bond conditions into the Texas
88 Crime Information Center.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 17, Code of Criminal Procedure, is
1111 amended by adding Article 17.50 to read as follows:
1212 Art. 17.50. ENTRY OF BOND CONDITIONS INTO TEXAS CRIME
1313 INFORMATION CENTER; DUTIES OF MAGISTRATES, SHERIFFS, AND
1414 DEPARTMENT OF PUBLIC SAFETY. (a) In this article, "database" means
1515 the statewide law enforcement information system maintained by the
1616 Department of Public Safety, also known as the Texas Crime
1717 Information Center.
1818 (b) As soon as possible but not later than the next business
1919 day after the date a magistrate imposes a condition of bond on an
2020 arrested person under this chapter, the magistrate shall notify the
2121 sheriff of the condition and provide to the sheriff the following
2222 information:
2323 (1) the name, sex, race, date of birth, personal
2424 descriptors, address, and county of residence of the person on whom
2525 the condition of bond is imposed;
2626 (2) any known identifying number of the person on whom
2727 the condition of bond is imposed, including the person's social
2828 security number or driver's license number;
2929 (3) the name and county of residence of any named
3030 person the condition of bond is intended to protect, and if
3131 different and applicable, the name and county of residence of the
3232 victim of the alleged offense; and
3333 (4) the condition of bond imposed.
3434 (c) On receipt of the information described by Subsection
3535 (b), the sheriff shall enter the information into the database.
3636 (d) As soon as possible but not later than the next business
3737 day after the date a magistrate revokes a bond that contains a
3838 condition, modifies the terms of or removes a condition of bond, or
3939 disposes of the underlying criminal charges in the case, the
4040 magistrate shall notify the sheriff and provide the sheriff with
4141 information that is sufficient to enable the sheriff to update the
4242 database accordingly.
4343 (e) The Department of Public Safety shall modify the
4444 database to enable the database to accept and maintain detailed
4545 information regarding the requirements and status of a condition of
4646 bond imposed by a magistrate, including information described by
4747 Subsections (b) and (d).
4848 (f) This article does not apply to a condition of bond
4949 imposed under Article 17.441.
5050 SECTION 2. Not later than January 1, 2020, the Department of
5151 Public Safety of the State of Texas shall modify the statewide law
5252 enforcement information system maintained by the department, also
5353 known as the Texas Crime Information Center, to enable the database
5454 to accept and maintain detailed information regarding the
5555 requirements and status of a condition of bond imposed by a
5656 magistrate, as required by Article 17.50(e), Code of Criminal
5757 Procedure, as added by this Act.
5858 SECTION 3. (a) Except as provided by Subsection (b) of this
5959 section, this Act takes effect January 1, 2020.
6060 (b) Section 2 of this Act takes effect September 1, 2019.
