| 8 | 8 | | driver responsibility program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 708.151(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) The department shall send notices as required by |
|---|
| 13 | 13 | | Subsection (b) to the holder of a driver's license when a surcharge |
|---|
| 14 | 14 | | is assessed on that license. Each notice must: |
|---|
| 15 | 15 | | (1) be sent by: |
|---|
| 16 | 16 | | (A) first class mail to the person's most recent |
|---|
| 17 | 17 | | address as shown on the records of the department or to the person's |
|---|
| 18 | 18 | | most recent forwarding address on record with the United States |
|---|
| 19 | 19 | | Postal Service if it is different; or |
|---|
| 20 | 20 | | (B) e-mail if the person has provided an e-mail |
|---|
| 21 | 21 | | address to the department and has elected to receive notice |
|---|
| 22 | 22 | | electronically; |
|---|
| 23 | 23 | | (2) specify the date by which the surcharge must be |
|---|
| 24 | 24 | | paid; |
|---|
| 25 | 25 | | (3) state the total dollar amount of the surcharge |
|---|
| 26 | 26 | | that must be paid, the total unpaid dollar amount of any previous |
|---|
| 27 | 27 | | surcharge, the number of monthly payments required under an |
|---|
| 28 | 28 | | installment payment plan, and the minimum monthly payment required |
|---|
| 29 | 29 | | for a person to enter and maintain an installment payment plan with |
|---|
| 30 | 30 | | the department; [and] |
|---|
| 31 | 31 | | (4) state the consequences of a failure to pay the |
|---|
| 32 | 32 | | surcharge; and |
|---|
| 33 | 33 | | (5) provide information about the surcharge waiver |
|---|
| 34 | 34 | | available under Section 708.158 for persons who are indigent. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2019. |
