66 AN ACT
77 relating to the required notice of a surcharge assessed under the
88 driver responsibility program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 708.151(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) The department shall send notices as required by
1313 Subsection (b) to the holder of a driver's license when a surcharge
1414 is assessed on that license. Each notice must:
1515 (1) be sent by:
1616 (A) first class mail to the person's most recent
1717 address as shown on the records of the department or to the person's
1818 most recent forwarding address on record with the United States
1919 Postal Service if it is different; or
2020 (B) e-mail if the person has provided an e-mail
2121 address to the department and has elected to receive notice
2222 electronically;
2323 (2) specify the date by which the surcharge must be
2424 paid;
2525 (3) state the total dollar amount of the surcharge
2626 that must be paid, the total unpaid dollar amount of any previous
2727 surcharge, the number of monthly payments required under an
2828 installment payment plan, and the minimum monthly payment required
2929 for a person to enter and maintain an installment payment plan with
3030 the department; [and]
3131 (4) state the consequences of a failure to pay the
3232 surcharge; and
3333 (5) provide information about the surcharge waiver
3434 available under Section 708.158 for persons who are indigent.
3535 SECTION 2. This Act takes effect September 1, 2019.
