68 AN ACT
79 relating to the punishment for the criminal offense of theft
810 involving a package delivered to or collected from a residential or
911 commercial property; increasing a criminal penalty.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 31.03, Penal Code, is amended by adding
1214 Subsection (d-1) and amending Subsection (e) to read as follows:
1315 (d-1) It is not a defense to prosecution of an offense
1416 punishable under Subsection (e)(3)(B) that the package is addressed
1517 to a person who is not the owner of the residential or commercial
1618 property from which the package was stolen.
1719 (e) Except as provided by Subsection (f), an offense under
1820 this section is:
1921 (1) a Class C misdemeanor if the value of the property
2022 stolen is less than $100;
2123 (2) a Class B misdemeanor if:
2224 (A) the value of the property stolen is $100 or
2325 more but less than $750;
2426 (B) the value of the property stolen is less than
2527 $100 and the defendant has previously been convicted of any grade of
2628 theft; or
2729 (C) the property stolen is a driver's license,
2830 commercial driver's license, or personal identification
2931 certificate issued by this state or another state;
3032 (3) a Class A misdemeanor if:
3133 (A) the value of the property stolen is $750 or
3234 more but less than $2,500; or
3335 (B) the value of the property stolen is less than
3436 $2,500 and the property is a package that:
3537 (i) has been delivered by a common carrier
3638 but not yet received by the addressee or has been left to be
3739 collected for delivery by a common carrier; and
3840 (ii) is stolen from a residential or
3941 commercial property, including the driveway, porch, front door, or
4042 any other area of the property;
4143 (4) a state jail felony if:
4244 (A) the value of the property stolen is $2,500 or
4345 more but less than $30,000, or the property is less than 10 head of
4446 sheep, swine, or goats or any part thereof under the value of
4547 $30,000;
4648 (B) regardless of value, the property is stolen
4749 from the person of another or from a human corpse or grave,
4850 including property that is a military grave marker;
4951 (C) the property stolen is a firearm, as defined
5052 by Section 46.01;
5153 (D) the value of the property stolen is less than
5254 $2,500 and the defendant has been previously convicted two or more
5355 times of any grade of theft;
5456 (E) the property stolen is an official ballot or
5557 official carrier envelope for an election; or
5658 (F) the value of the property stolen is less than
5759 $20,000 and the property stolen is:
5860 (i) aluminum;
5961 (ii) bronze;
6062 (iii) copper; or
6163 (iv) brass;
6264 (5) a felony of the third degree if the value of the
6365 property stolen is $30,000 or more but less than $150,000, or the
6466 property is:
6567 (A) cattle, horses, or exotic livestock or exotic
6668 fowl as defined by Section 142.001, Agriculture Code, stolen during
6769 a single transaction and having an aggregate value of less than
6870 $150,000;
6971 (B) 10 or more head of sheep, swine, or goats
7072 stolen during a single transaction and having an aggregate value of
7173 less than $150,000; or
7274 (C) a controlled substance, having a value of
7375 less than $150,000, if stolen from:
7476 (i) a commercial building in which a
7577 controlled substance is generally stored, including a pharmacy,
7678 clinic, hospital, nursing facility, or warehouse; or
7779 (ii) a vehicle owned or operated by a
7880 wholesale distributor of prescription drugs;
7981 (6) a felony of the second degree if:
8082 (A) the value of the property stolen is $150,000
8183 or more but less than $300,000; or
8284 (B) the value of the property stolen is less than
8385 $300,000 and the property stolen is an automated teller machine or
8486 the contents or components of an automated teller machine; or
8587 (7) a felony of the first degree if the value of the
8688 property stolen is $300,000 or more.
8789 SECTION 2. Section 31.03(h), Penal Code, is amended by
8890 adding Subdivision (7) to read as follows:
8991 (7) "Package" means a box, container, bag, or other
9092 sealed article holding a good or product.
9193 SECTION 3. The change in law made by this Act applies only
9294 to an offense committed on or after the effective date of this Act.
9395 An offense committed before the effective date of this Act is
9496 governed by the law in effect on the date the offense was committed,
9597 and the former law is continued in effect for that purpose. For
9698 purposes of this section, an offense was committed before the
9799 effective date of this Act if any element of the offense occurred
98100 before that date.
99101 SECTION 4. This Act takes effect September 1, 2019.
