66 AN ACT
77 relating to prohibiting political contributions and political
88 expenditures made by certain persons with public funds; creating a
99 criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 253, Election Code, is
1212 amended by adding Section 253.006 to read as follows:
1313 Sec. 253.006. UNLAWFUL USE OF PUBLIC FUNDS FOR
1414 CONTRIBUTIONS OR EXPENDITURES. (a) An officer or employee of a
1515 political subdivision may not spend or authorize the spending of
1616 public funds to make a political contribution or a political
1717 expenditure.
1818 (b) An officer or employee of a political subdivision may
1919 not directly or indirectly employ a person to use public funds to
2020 make an unlawful political contribution or political expenditure.
2121 (c) A person who violates Subsection (a) or (b) commits an
2222 offense. An offense under this section is a Class A misdemeanor.
2323 SECTION 2. Section 253.006, Election Code, as added by this
2424 Act, applies only to a political contribution or a political
2525 expenditure made on or after the effective date of this Act.
2626 SECTION 3. This Act takes effect September 1, 2019.
