115 A BILL TO BE ENTITLED
126 AN ACT
137 relating to the consideration of certain student differentials
148 based on sex under the public school accountability system.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Section 39.053(c), Education Code, as amended by
1711 Chapters 807 (H.B. 22), 842 (H.B. 2223), and 1088 (H.B. 3593), Acts
1812 of the 85th Legislature, Regular Session, 2017, is reenacted and
1913 amended to read as follows:
2014 (c) School districts and campuses must be evaluated based on
2115 three domains of indicators of achievement adopted under this
2216 section that include:
2317 (1) in the student achievement domain, indicators of
2418 student achievement that must include:
2519 (A) for evaluating the performance of districts
2620 and campuses generally:
2721 (i) an indicator that accounts for the
2822 results of assessment instruments required under Sections
2923 39.023(a), (c), and (l), as applicable for the district and campus,
3024 including the results of assessment instruments required for
3125 graduation retaken by a student, aggregated across grade levels by
3226 subject area, including:
3327 (a) for the performance standard
3428 determined by the commissioner under Section 39.0241(a), the
3529 percentage of students who performed satisfactorily on the
3630 assessment instruments, aggregated across grade levels by subject
3731 area; and
3832 (b) for the college readiness
3933 performance standard as determined under Section 39.0241, the
4034 percentage of students who performed satisfactorily on the
4135 assessment instruments, aggregated across grade levels by subject
4236 area; and
4337 (ii) an indicator that accounts for the
4438 results of assessment instruments required under Section
4539 39.023(b), as applicable for the district and campus, including the
4640 percentage of students who performed satisfactorily on the
4741 assessment instruments, as determined by the performance standard
4842 adopted by the agency, aggregated across grade levels by subject
4943 area; and
5044 (B) for evaluating the performance of high school
5145 campuses and districts that include high school campuses,
5246 indicators that account for:
5347 (i) students who satisfy the Texas Success
5448 Initiative (TSI) college readiness benchmarks prescribed by the
5549 Texas Higher Education Coordinating Board under Section 51.334 on
5650 an assessment instrument in reading or mathematics designated by
5751 the coordinating board under that section;
5852 (ii) students who satisfy relevant
5953 performance standards on advanced placement tests or similar
6054 assessments;
6155 (iii) students who earn dual course credits
6256 in the dual credit courses;
6357 (iv) students who enlist in the armed
6458 forces of the United States;
6559 (v) students who earn industry
6660 certifications;
6761 (vi) students admitted into postsecondary
6862 industry certification programs that require as a prerequisite for
6963 entrance successful performance at the secondary level;
7064 (vii) students whose successful completion
7165 of a course or courses under Section 28.014 indicates the student's
7266 preparation to enroll and succeed, without remediation, in an
7367 entry-level general education course for a baccalaureate degree or
7468 associate degree;
7569 (viii) students who successfully met
7670 standards on a composite of indicators that through research
7771 indicates the student's preparation to enroll and succeed, without
7872 remediation, in an entry-level general education course for a
7973 baccalaureate degree or associate degree;
8074 (ix) high school graduation rates, computed
8175 in accordance with standards and definitions adopted in compliance
8276 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
8377 subject to the exclusions provided by Subsections (g), (g-1),
8478 (g-2), and (g-3);
8579 (x) students who successfully completed an
8680 OnRamps dual enrollment course; [and]
8781 (xi) [the percentage of] students who
8882 successfully completed a practicum or internship approved by the
8983 State Board of Education; and
9084 (xii) students who are awarded an associate
9185 [associate's] degree;
9286 (2) in the school progress domain, indicators for
9387 effectiveness in promoting student learning, which must include:
9488 (A) for assessment instruments, including
9589 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
9690 percentage of students who met the standard for improvement, as
9791 determined by the commissioner; and
9892 (B) for evaluating relative performance, the
9993 performance of districts and campuses compared to similar districts
10094 or campuses; and
10195 (3) in the closing the gaps domain, the use of
10296 disaggregated data to demonstrate the differentials among
10397 students:
10498 (A) from different:
105- (i) racial and ethnic groups, including
106- African American and Hispanic students:
107- (a) considered as a whole; and
108- (b) disaggregated by sex; and
99+ (i) racial and ethnic groups, disaggregated
100+ by sex, including African American and Hispanic students; and
109101 (ii) socioeconomic backgrounds; [,] and
110102 (B) based on other relevant factors not described
111103 by Paragraph (A), including:
112104 (i) [(A)] students formerly receiving
113105 special education services;
114106 (ii) [(B)] students continuously enrolled;
115107 and
116108 (iii) [(C)] students who are mobile.
117109 SECTION 2. Section 39.053, Education Code, is amended by
118110 adding Subsection (i-1) to read as follows:
119- (i-1) Notwithstanding Subsection (c)(3)(A)(i)(b),
120- information reported under that sub-subparagraph may not be used by
111+ (i-1) Notwithstanding Subsection (c)(3)(A)(i), information
112+ reported under that subparagraph regarding sex may not be used by
121113 the agency for accountability purposes before the accountability
122114 ratings assigned for the 2022-2023 school year. This subsection
123115 expires September 1, 2023.
124116 SECTION 3. This Act applies beginning with the 2019-2020
125117 school year.
126118 SECTION 4. To the extent of any conflict, this Act prevails
127119 over another Act of the 86th Legislature, Regular Session, 2019,
128120 relating to nonsubstantive additions to and corrections in enacted
129121 codes.
130122 SECTION 5. This Act takes effect immediately if it receives
131123 a vote of two-thirds of all the members elected to each house, as
132124 provided by Section 39, Article III, Texas Constitution. If this
133125 Act does not receive the vote necessary for immediate effect, this
134126 Act takes effect September 1, 2019.
