55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to money used by counties that participate in the
88 low-income vehicle repair assistance, retrofit, and accelerated
99 vehicle retirement program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 403.071(b), Government Code, is amended
1212 to read as follows:
1313 (b) A claim may not be paid from an appropriation unless the
1414 claim is presented to the comptroller for payment not later than two
1515 years after the end of the fiscal year for which the appropriation
1616 was made. However, a claim may be presented not later than four
1717 years after the end of the fiscal year for which the appropriation
1818 from which the claim is to be paid was made if the appropriation
1919 relates to:
2020 (1) new construction contracts;
2121 (2) funding for a local initiative project described
2222 by Section 382.220 or 382.221, Health and Safety Code, that
2323 involves construction in a county described by Section 382.221,
2424 Health and Safety Code;
2525 (3) [, to] grants awarded under Chapter 391, Health
2626 and Safety Code;
2727 (4) [, or to] repair and remodeling projects that
2828 exceed the amount of $20,000, including furniture and other
2929 equipment, architects' and engineering fees; or
3030 (5) [, and] other costs related to the contracts, [or]
3131 projects, or grants.
3232 SECTION 2. Section 382.202(g), Health and Safety Code, is
3333 amended to read as follows:
3434 (g) The commission shall:
3535 (1) use part of the fee collected under Subsection (e)
3636 to fund low-income vehicle repair assistance, retrofit, and
3737 accelerated vehicle retirement programs created under Section
3838 382.209; and
3939 (2) to the extent practicable, disburse [distribute]
4040 available funding created under Subsection (e) among [to]
4141 participating counties:
4242 (A) in reasonable proportion to the amount of
4343 fees collected under Subsection (e) in those counties or in the
4444 regions in which those counties are located; and
4545 (B) so that a county with a population of at least
4646 four million receives 90 percent of the revenue derived from fees
4747 collected in the county.
4848 SECTION 3. Subchapter G, Chapter 382, Health and Safety
4949 Code, is amended by adding Section 382.221 to read as follows:
5050 Sec. 382.221. LOW-INCOME VEHICLE REPAIR ASSISTANCE,
5151 RETROFIT, AND ACCELERATED VEHICLE RETIREMENT PROGRAM AND LOCAL
5252 INITIATIVE PROJECTS IN CERTAIN COUNTIES. (a) This section applies
5353 only to a county with a population of at least four million that
5454 participates in the low-income vehicle repair assistance,
5555 retrofit, and accelerated vehicle retirement program created under
5656 Section 382.209.
5757 (b) To the extent that this section is inconsistent or in
5858 conflict with another provision of this subchapter, this section
5959 prevails.
6060 (c) A project a county implements under Section 382.220 may
6161 include a program to enhance transportation system improvements,
6262 including improvements meant to reduce congestion on existing
6363 roads, but not including toll projects.
6464 (d) A county may use fees collected under Sections 382.202
6565 and 382.302 for a program or project described by Section 382.220 or
6666 this section. A county that receives money under Section 382.220 or
6767 this section:
6868 (1) is not required to provide matching funds for a
6969 program or project; and
7070 (2) may allocate money to a program or project under
7171 Section 382.209, Section 382.220, or this section at the discretion
7272 of the county.
7373 (e) Money used by a county to implement a program or project
7474 under Section 382.220 or this section that involves construction
7575 for a fiscal year may be disbursed to the county to be used for the
7676 program or project in subsequent fiscal years if the money has been
7777 made available to the county and has been treated as a binding
7878 encumbrance by the commission before the end of the appropriation
7979 year of the money appropriated for those purposes. Disbursement of
8080 the money is subject to Section 403.071, Government Code.
8181 SECTION 4. This Act takes effect September 1, 2019.
