55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to addressing adverse childhood experiences and
88 developing a strategic plan to address those experiences.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0222 to read as follows:
1212 Sec. 531.0222. COORDINATION TO ADDRESS ADVERSE CHILDHOOD
1313 EXPERIENCES; STRATEGIC PLAN. (a) In this section, "adverse
1414 childhood experience" includes:
1515 (1) abuse as defined by Section 261.001, Family Code;
1616 (2) neglect as defined by Section 261.001, Family
1717 Code;
1818 (3) family violence as defined by Section 71.004,
1919 Family Code;
2020 (4) intimate partner violence;
2121 (5) parental separation or divorce; and
2222 (6) substance use disorder, mental illness, or
2323 incarceration of a member of a child's household.
2424 (b) In order to reduce exposure of children in this state to
2525 adverse childhood experiences and to address the social, health,
2626 and economic impacts of those experiences, the commission, in
2727 collaboration with the Department of Family and Protective
2828 Services, the Department of State Health Services, the Texas
2929 Education Agency, the Texas Workforce Commission, and an
3030 institution of higher education, as defined by Section 61.003,
3131 Education Code, with expertise in addressing adverse childhood
3232 experiences through a public health framework shall:
3333 (1) analyze data related to the causes and effects of
3434 adverse childhood experiences, including data from the Behavioral
3535 Risk Factor Surveillance System established by the Centers for
3636 Disease Control and Prevention of the United States Public Health
3737 Service;
3838 (2) evaluate prevention needs and gaps in services and
3939 support regarding awareness of, screening for, and treatment of
4040 adverse childhood experiences;
4141 (3) identify methods to incorporate best practices for
4242 preventing and treating adverse childhood experiences into
4343 existing services and support programs offered for children and
4444 families; and
4545 (4) develop and implement a five-year strategic plan
4646 to prevent and address adverse childhood experiences.
4747 (c) In developing the five-year strategic plan under
4848 Subsection (b)(4), the commission may collaborate with
4949 representatives of:
5050 (1) state and local agencies and nonprofit
5151 organizations that work directly with children and families;
5252 (2) child welfare services providers;
5353 (3) early childhood education programs;
5454 (4) public schools;
5555 (5) medical and mental health services providers;
5656 (6) social services providers;
5757 (7) the law enforcement and criminal justice
5858 community;
5959 (8) faith-based organizations; and
6060 (9) the business community.
6161 (d) The strategic plan must incorporate a public health
6262 approach that promotes collaboration between agencies and
6363 community-based providers. The strategic plan may include
6464 strategies to:
6565 (1) train and educate professionals to assess, treat,
6666 and prevent adverse childhood experiences;
6767 (2) provide trauma-informed practices;
6868 (3) provide high quality child care;
6969 (4) provide support to parents to develop social and
7070 economic independence;
7171 (5) develop voluntary, evidence-based home visiting
7272 programs specifically developed to meet the needs of women who are
7373 pregnant and families with an infant to strengthen parenting skills
7474 and the child's social and emotional development;
7575 (6) develop parental support programs for teen parents
7676 and young mothers;
7777 (7) develop parental education training and
7878 counseling programs;
7979 (8) identify best practices for child protective
8080 services;
8181 (9) treat mental illness and substance use disorder;
8282 and
8383 (10) prevent intimate partner and family violence.
8484 (e) The commission shall publish the five-year strategic
8585 plan required by Subsection (b) on the commission's Internet
8686 website.
8787 SECTION 2. Not later than December 1, 2020, the Health and
8888 Human Services Commission shall:
8989 (1) develop the five-year strategic plan required by
9090 Section 531.0222(b)(4), Government Code, as added by this Act; and
9191 (2) submit a report to the Senate Health and Human
9292 Services Committee, the House Public Health Committee, and the
9393 House Human Services Committee regarding the commission's
9494 strategies for preventing and treating adverse childhood
9595 experiences and any plan to incorporate those strategies into
9696 existing services and support programs for children and families.
9797 SECTION 3. This Act takes effect September 1, 2019.
