55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to credit toward payment of a fine and costs for certain
88 misdemeanants confined in jail or prison before sentencing.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 45.041, Code of Criminal Procedure, is
1111 amended by amending Subsection (c) and adding Subsections (c-1) and
1212 (c-2) to read as follows:
1313 (c) The justice or judge shall credit the defendant for time
1414 served in jail as provided by Article 42.03.
1515 (c-1) In addition to credit under Subsection (c), in
1616 imposing a fine and costs in a case involving a misdemeanor
1717 punishable by a fine only, the justice or judge shall credit the
1818 defendant for any time the defendant was confined in jail or prison
1919 while serving a sentence for another offense if that confinement
2020 occurred after the commission of the misdemeanor.
2121 (c-2) A [The] credit under Subsection (c) or (c-1) shall be
2222 applied to the amount of the fine and costs at the rate provided by
2323 Article 45.048.
2424 SECTION 2. The change in law made by this Act applies to a
2525 defendant who is sentenced for an offense on or after the effective
2626 date of this Act, regardless of whether the offense is committed
2727 before, on, or after the effective date of this Act.
2828 SECTION 3. This Act takes effect September 1, 2019.
