| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Article 45.041, Code of Criminal Procedure, is | |
| 11 | 11 | amended by amending Subsection (c) and adding Subsections (c-1) and | |
| 12 | 12 | (c-2) to read as follows: | |
| 13 | 13 | (c) The justice or judge shall credit the defendant for time | |
| 14 | 14 | served in jail as provided by Article 42.03. | |
| 15 | 15 | (c-1) In addition to credit under Subsection (c), in | |
| 16 | 16 | imposing a fine and costs in a case involving a misdemeanor | |
| 17 | 17 | punishable by a fine only, the justice or judge shall credit the | |
| 18 | 18 | defendant for any time the defendant was confined in jail or prison | |
| 19 | 19 | while serving a sentence for another offense if that confinement | |
| 20 | 20 | occurred after the commission of the misdemeanor. | |
| 21 | 21 | (c-2) A [The] credit under Subsection (c) or (c-1) shall be | |
| 22 | 22 | applied to the amount of the fine and costs at the rate provided by | |
| 23 | 23 | Article 45.048. | |
| 24 | 24 | SECTION 2. The change in law made by this Act applies to a | |
| 25 | 25 | defendant who is sentenced for an offense on or after the effective | |
| 26 | 26 | date of this Act, regardless of whether the offense is committed | |
| 27 | 27 | before, on, or after the effective date of this Act. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2019. |
