79 relating to an agreement between the Department of Public Safety
810 and a county, municipality, or private vendor for the issuance of
911 renewal and duplicate driver's licenses and other identification
1012 certificate services; increasing a fee.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Sections 521.009(a), (a-1), and (c),
1315 Transportation Code, are amended to read as follows:
1416 (a) The department may establish a program for the provision
1517 of renewal and duplicate driver's license, election identification
1618 certificate, and personal identification certificate services by
1719 [in] counties, [and] municipalities, and private vendors that enter
1820 into an agreement with the department under Subsection (a-1).
1921 (a-1) Under the program, the department may enter into an
2022 agreement with the commissioners court of a county, [or] the
2123 governing body of a municipality, or a private vendor to permit
2224 county, [or] municipal, or vendor employees to provide services at
2325 a county or municipal office or at a location determined by the
2426 vendor relating to the issuance of renewal and duplicate driver's
2527 licenses, election identification certificates, and personal
2628 identification certificates, including:
2729 (1) taking photographs;
2830 (2) administering vision tests;
2931 (3) updating a driver's license, election
3032 identification certificate, or personal identification certificate
3133 to change a name, address, or photograph;
3234 (4) distributing and collecting information relating
3335 to donations under Section 521.401;
3436 (5) collecting fees; and
3537 (6) performing other basic ministerial functions and
3638 tasks necessary to issue renewal and duplicate driver's licenses,
3739 election identification certificates, and personal identification
3840 certificates.
3941 (c) A participating county, [or] municipality, or private
4042 vendor must remit to the department for deposit as required by this
4143 chapter fees collected for the issuance of a renewal or duplicate
4244 driver's license or personal identification certificate.
4345 SECTION 2. Section 521.428, Transportation Code, is amended
4446 to read as follows:
4547 Sec. 521.428. COUNTY, [OR] MUNICIPAL, OR PRIVATE VENDOR
4648 FEE. A county, [or] municipality, or private vendor that provides
4749 services under an agreement described by Section 521.009 may
4850 collect an additional fee of up to $10 [$5] for each transaction
4951 provided that relates to driver's license and personal
5052 identification certificate services only.
5153 SECTION 3. This Act takes effect September 1, 2019.
