55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the group benefits advisory committee for the board of
88 trustees of the Employees Retirement System of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1551, Insurance Code, is amended by
1111 adding Subchapter K to read as follows:
1212 SUBCHAPTER K. GROUP BENEFITS ADVISORY COMMITTEE
1313 Sec. 1551.501. DEFINITION. In this subchapter, "committee"
1414 means the group benefits advisory committee established by the
1515 board of trustees.
1616 Sec. 1551.502. COMMITTEE APPOINTMENT. (a) The board of
1717 trustees shall appoint the committee members.
1818 (b) The staff of the board of trustees shall name nominees
1919 for appointment after the staff considers applications for
2020 committee membership from interested parties. The board of
2121 trustees shall establish the application and nomination process.
2222 Sec. 1551.503. COMMITTEE COMPOSITION; TERM. (a) The
2323 committee is composed of not more than 11 members.
2424 (b) Committee members serve staggered three-year terms.
2525 Sec. 1551.504. COMMITTEE MEMBER DIVERSITY; QUALIFICATIONS.
2626 (a) The board of trustees shall appoint committee members from a
2727 diverse cross-section of agencies covered by the group benefits
2828 program and other stakeholders as determined by the board.
2929 (b) The appointees must meet qualifications and comply with
3030 requirements and restrictions established by the board of trustees
3131 to retain a position on the committee and participate in committee
3232 business.
3333 Sec. 1551.505. AT WILL MEMBERSHIP. Committee members serve
3434 at the will of the board of trustees and may be removed at any time
3535 at the discretion of the board.
3636 Sec. 1551.506. PRESIDING OFFICER. The presiding officer of
3737 the board of trustees shall appoint a chairperson of the committee
3838 from the committee's membership to serve a one-year term.
3939 Sec. 1551.507. DUTIES OF COMMITTEE. The committee shall:
4040 (1) advise and consult with the board of trustees on
4141 matters concerning all group coverages provided under this chapter;
4242 (2) present recommendations to the board regarding
4343 other existing or proposed state employee benefits, other than
4444 retirement benefits; and
4545 (3) cooperate and work with the board in coordinating
4646 and correlating the administration of the group benefits program
4747 among the various state agencies.
4848 Sec. 1551.508. MEETINGS. (a) The committee shall have
4949 regular meetings and may have special meetings to conduct committee
5050 business.
5151 (b) The board of trustees shall establish the date, time,
5252 and location of any meeting under this section and the procedures
5353 for convening and conducting committee meetings.
5454 (c) The committee is not a governmental body as defined by
5555 Chapter 551, Government Code. The board of trustees may establish
5656 notice requirements for any committee meeting.
5757 Sec. 1551.509. MEETING MINUTES. Not less than twice
5858 annually, the staff of the board of trustees shall prepare and
5959 provide to the board minutes or summaries of committee meetings.
6060 Sec. 1551.510. COMMITTEE REPORT. (a) At least once
6161 annually during a public meeting of the board of trustees, the
6262 committee shall present a report of the committee activities,
6363 findings, and recommendations.
6464 (b) The staff of the board of directors shall assist the
6565 committee in preparing the report and presentation.
6666 (c) The executive director may require the committee to
6767 present the report required under Subsection (a) more than once a
6868 year.
6969 Sec. 1551.511. COMMITTEE MEMBER EXPENSES. The board of
7070 trustees may determine by rule the amount and manner of expense
7171 reimbursement to be paid to committee members.
7272 Sec. 1551.512. CONSTRUCTION WITH OTHER LAW. To the extent
7373 of any conflict between Chapter 2110, Government Code, and a
7474 provision of this chapter, this chapter controls.
7575 SECTION 2. This Act takes effect September 1, 2019.
