68 AN ACT
79 relating to the inclusion of satisfactory performance on certain
810 postsecondary readiness assessment instruments in the indicators
911 for evaluating the performance of public schools.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 39.0238(f), Education Code, is amended
1214 to read as follows:
1315 (f) The results of a postsecondary readiness assessment
1416 instrument administered under this section may not be used by:
1517 (1) [the agency for accountability purposes for a
1618 school campus or school district;
1719 [(2)] a school district:
1820 (A) for the purpose of teacher evaluations; or
1921 (B) in determining a student's final course grade
2022 or determining a student's class rank for the purpose of high school
2123 graduation; or
2224 (2) [(3)] an institution of higher education:
2325 (A) for admission purposes; or
2426 (B) to determine eligibility for a TEXAS grant.
2527 SECTION 2. Section 39.053(c), Education Code, as amended by
2628 Chapters 807 (H.B. 22), 842 (H.B. 2223), and 1088 (H.B. 3593), Acts
2729 of the 85th Legislature, Regular Session, 2017, is reenacted and
2830 amended to read as follows:
2931 (c) School districts and campuses must be evaluated based on
3032 three domains of indicators of achievement adopted under this
3133 section that include:
3234 (1) in the student achievement domain, indicators of
3335 student achievement that must include:
3436 (A) for evaluating the performance of districts
3537 and campuses generally:
3638 (i) an indicator that accounts for the
3739 results of assessment instruments required under Sections
3840 39.023(a), (c), and (l), as applicable for the district and campus,
3941 including the results of assessment instruments required for
4042 graduation retaken by a student, aggregated across grade levels by
4143 subject area, including:
4244 (a) for the performance standard
4345 determined by the commissioner under Section 39.0241(a), the
4446 percentage of students who performed satisfactorily on the
4547 assessment instruments, aggregated across grade levels by subject
4648 area; and
4749 (b) for the college readiness
4850 performance standard as determined under Section 39.0241, the
4951 percentage of students who performed satisfactorily on the
5052 assessment instruments, aggregated across grade levels by subject
5153 area; and
5254 (ii) an indicator that accounts for the
5355 results of assessment instruments required under Section
5456 39.023(b), as applicable for the district and campus, including the
5557 percentage of students who performed satisfactorily on the
5658 assessment instruments, as determined by the performance standard
5759 adopted by the agency, aggregated across grade levels by subject
5860 area; and
5961 (B) for evaluating the performance of high school
6062 campuses and districts that include high school campuses,
6163 indicators that account for:
6264 (i) students who satisfy the Texas Success
6365 Initiative (TSI) college readiness benchmarks prescribed by the
6466 Texas Higher Education Coordinating Board under Section 51.334 on
6567 an assessment instrument in reading or mathematics designated by
6668 the coordinating board under that section;
6769 (ii) students who satisfy relevant
6870 performance standards on advanced placement tests or similar
6971 assessments;
7072 (iii) students who earn dual course credits
7173 in the dual credit courses;
7274 (iv) students who enlist in the armed
7375 forces of the United States;
7476 (v) students who earn industry
7577 certifications;
7678 (vi) students admitted into postsecondary
7779 industry certification programs that require as a prerequisite for
7880 entrance successful performance at the secondary level;
7981 (vii) students whose successful completion
8082 of a course or courses under Section 28.014 indicates the student's
8183 preparation to enroll and succeed, without remediation, in an
8284 entry-level general education course for a baccalaureate degree or
8385 associate degree;
8486 (viii) students who successfully met
8587 standards on a composite of indicators that through research
8688 indicates the student's preparation to enroll and succeed, without
8789 remediation, in an entry-level general education course for a
8890 baccalaureate degree or associate degree;
8991 (ix) high school graduation rates, computed
9092 in accordance with standards and definitions adopted in compliance
9193 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
9294 subject to the exclusions provided by Subsections (g), (g-1),
9395 (g-2), and (g-3);
9496 (x) students who successfully completed an
9597 OnRamps dual enrollment course; [and]
9698 (xi) [the percentage of] students who
9799 successfully completed a practicum or internship approved by the
98100 State Board of Education;
99101 (xii) students who are awarded an associate
100102 [associate's] degree; and
101103 (xiii) students who:
102104 (a) satisfy the relevant performance
103105 standards on an Algebra II or English III postsecondary readiness
104106 assessment instrument administered under Section 39.0238; or
105107 (b) successfully completed an Algebra
106108 II or English III course with a grade of at least the equivalent of
107109 70 on a scale of 100;
108110 (2) in the school progress domain, indicators for
109111 effectiveness in promoting student learning, which must include:
110112 (A) for assessment instruments, including
111113 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
112114 percentage of students who met the standard for improvement, as
113115 determined by the commissioner; and
114116 (B) for evaluating relative performance, the
115117 performance of districts and campuses compared to similar districts
116118 or campuses; and
117119 (3) in the closing the gaps domain, the use of
118120 disaggregated data to demonstrate the differentials among students
119121 from different racial and ethnic groups, socioeconomic
120122 backgrounds, and other factors, including:
121123 (A) students formerly receiving special
122124 education services;
123125 (B) students continuously enrolled; and
124126 (C) students who are mobile.
125127 SECTION 3. To the extent of any conflict, this Act prevails
126128 over another Act of the 86th Legislature, Regular Session, 2019,
127129 relating to nonsubstantive additions to and corrections in enacted
128130 codes.
129131 SECTION 4. This Act applies beginning with the 2019-2020
130132 school year.
131133 SECTION 5. This Act takes effect immediately if it receives
132134 a vote of two-thirds of all the members elected to each house, as
133135 provided by Section 39, Article III, Texas Constitution. If this
134136 Act does not receive the vote necessary for immediate effect, this
135137 Act takes effect September 1, 2019.
