55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of individual graduation committees and other
88 alternative methods to satisfy certain public high school
99 graduation requirements.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 12.104(b-2) and (b-3), Education Code,
1212 are amended to read as follows:
1313 (b-2) An open-enrollment charter school is subject to the
1414 requirement to establish an individual graduation committee under
1515 Section 28.0258. [This subsection expires September 1, 2019.]
1616 (b-3) An open-enrollment charter school is subject to the
1717 graduation qualification procedure established by the commissioner
1818 under Section 28.02541. [This subsection expires September 1,
1919 2019.]
2020 SECTION 2. Section 28.025(c-6), Education Code, is amended
2121 to read as follows:
2222 (c-6) Notwithstanding Subsection (c), a person may receive
2323 a diploma if the person is eligible for a diploma under Section
2424 28.0258. [This subsection expires September 1, 2019.]
2525 SECTION 3. Effective September 1, 2019, Section
2626 28.02541(a), Education Code, is amended to read as follows:
2727 (a) This section applies only to a student who:
2828 (1) entered the ninth grade before the 2011-2012
2929 school year;
3030 (2) successfully completed the curriculum
3131 requirements for high school graduation applicable to the student
3232 when the student entered the ninth grade;
3333 (3) has not performed satisfactorily on an assessment
3434 instrument or a part of an assessment instrument required for high
3535 school graduation, including an alternate assessment instrument
3636 offered under Section 39.025(c-2) [39.025(c-1)]; and
3737 (4) has been administered the assessment instrument or
3838 the part of the assessment instrument for which the student has not
3939 performed satisfactorily at least three times.
4040 SECTION 4. Section 28.02591(a), Education Code, is amended
4141 to read as follows:
4242 (a) The Texas Higher Education Coordinating Board, in
4343 coordination with the agency, shall collect longitudinal data
4444 relating to the post-graduation pursuits of each student who is
4545 awarded a diploma based on the determination of an individual
4646 graduation committee under Section 28.0258, [as that section
4747 existed before September 1, 2019,] including whether the student:
4848 (1) enters the workforce;
4949 (2) enrolls in an associate degree or certificate
5050 program at a public or private institution of higher education;
5151 (3) enrolls in a bachelor's degree program at a public
5252 or private institution of higher education; or
5353 (4) enlists in the armed forces of the United States or
5454 the Texas National Guard.
5555 SECTION 5. Subsection (a-2), Section 39.025, Education
5656 Code, as added by Chapter 5 (S.B. 149), Acts of the 84th
5757 Legislature, Regular Session, 2015, is redesignated as Subsection
5858 (a-5), Section 39.025, Education Code, and amended to read as
5959 follows:
6060 (a-5) [(a-2)] Notwithstanding Subsection (a), a student who
6161 has failed to perform satisfactorily on end-of-course assessment
6262 instruments in the manner provided under this section may receive a
6363 high school diploma if the student has qualified for graduation
6464 under Section 28.0258. [This subsection expires September 1,
6565 2019.]
6666 SECTION 6. Section 39.025(a-3), Education Code, is amended
6767 to read as follows:
6868 (a-3) A student who, after retaking an end-of-course
6969 assessment instrument for Algebra I or English II, has failed to
7070 perform satisfactorily as required by Subsection (a), but who
7171 receives a score of proficient on the Texas Success Initiative
7272 (TSI) diagnostic assessment for the corresponding subject for which
7373 the student failed to perform satisfactorily on the end-of-course
7474 assessment instrument satisfies the requirement concerning the
7575 Algebra I or English II end-of-course assessment, as applicable.
7676 [This subsection expires September 1, 2019.]
7777 SECTION 7. Sections 28.02541(g), 28.0258(l), and
7878 28.0259(e), Education Code, are repealed.
7979 SECTION 8. Except as otherwise provided by this Act, this
8080 Act takes effect immediately if it receives a vote of two-thirds of
8181 all the members elected to each house, as provided by Section 39,
8282 Article III, Texas Constitution. If this Act does not receive the
8383 vote necessary for immediate effect, this Act takes effect on the
8484 91st day after the last day of the legislative session.
